October 28, 2014 <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe road <br />conditions around the site; <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in the zoning districts; and <br />(h) Complies with all other city, state, and federal laws and regulations. <br />2. That Dawn Richardson is hereby granted a use permit pursuant to Section <br />40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to operate a Bed and <br />Breakfast Inn at 497 North Street in the Olde Towne Historic District, Portsmouth, <br />Virginia, and being more particularly described as: <br />UP-14-12 <br />497 North Street <br />ALL THAT certain lot, piece or parcel of land with the buildings and improvements <br />thereon, and the appurtenances thereunto appertaining, situate in the City of <br />Portsmouth, in the State of Virginia, and bounded and described as follows: <br />Beginning at the South-East intersection of Dinwiddie and North Streets; thence <br />Southerly along the East side of Dinwiddie Street, Seventy-four (74) feet, Six (6) inches, <br />to the line of C. T. Phillips; thence Easterly along said C. T. Phillips line, Fifty-one (51) <br />feet, Three (3) inches; thence Northerly Seventy-Three (73) feet, Nine (9) inches to <br />North Street, at a point district Fifty-one (51) feet, Ten and One Half (10 '/) inches East <br />from Dinwiddie Street; thence West along North Street Fifty-One (51) feet, Ten and One <br />Half (10'/) inches to the point of beginning. <br />BEING all that property conveyed to Dawn D. Richardson by Deed from C. Pierce Tyler <br />and Claudia P. DuVernet dated August 2, 2012 and recorded in the Portsmouth Circuit <br />Court Clerk's Office as Instrument Number 120008434. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) No more than three (3) bedrooms shall be used for the Bed and Breakfast Inn. <br />(b) The applicant shall adhere to the regulations listed in Section 40.1-4.3(C)(12)(a) <br />of the Zoning Ordinance ("Bed and Breakfast Inns"). <br />(c) The applicant shall adhere to the standards listed in Section 40.1-2(B)(4) of the <br />Zoning Ordinance ("Use Permit Standards"). <br />(d) The applicant shall obtain and maintain a parking arrangement with the <br />Portsmouth Parking Authority for five parking spaces to meet the off-street parking <br />requirement of the Zoning Ordinance. <br />(e) The Bed and Breakfast Inn shall be operated in accordance with all applicable <br />codes, ordinances, and regulations of federal, state and local governments. <br />(f) All taxes/fees associated with the property and the use shall be paid when due. <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by City Council." <br />14-384 (c): <br />"ZONING AMENDMENT ORDINANCE Z-14-02." <br />
