October 28, 2014 Beginning at a point on the north side of Blair Street (formerly B Street) 197 feet west from the northwest intersection of Hatton Street and Blair Street (formerly B Street) and from said point of beginning running thence west along the north side of Blair Street (formerly B Street) 56 feet; thence north and parallel with Hatton Street 116 feet; thence east and parallel with Blair Street (formerly B Street) 56 feet; and thence south and parallel with Hatton Street 116 feet to the point of beginning. BEING all that property conveyed to Richelle Scott by Deed of Bargain and Sale from Fred Alston, Sr. dated August 24, 2005 and recorded in the Portsmouth Circuit Court Clerk's Office as Instrument Number 050017762. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) Days and hours of operation shall be limited to Monday through Friday, between 5:00 a. m. and 8:30 p. m. (b) The applicant shall maintain three of the four driveway spaces for the child day care activity during hours of operation. (c) The facility shall be operated in compliance with applicable codes, ordinances and regulations of federal, state and local government and all required licenses and permits shall be obtained and remain in effect during the operation of the Child Day Care Center. (d) All taxes/fees associated with the property and the use shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by City Council." 14-384 (b): "RESOLUTION GRANTING A USE PERMIT (UP-14-12) TO DAWN RICHARDSON TO OPERATE A BED AND BREAKFAST INN AT 497 NORTH STREET IN THE OLDE TOWNE HISTORIC DISTRICT. WHEREAS, Dawn Richardson, the owner of the subject property, has made application pursuant to Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) for a use permit to operate a Bed and Breakfast Inn at 497 North Street in the Olde Towne Historic District, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought: (a) Complies with the applicable standards of the Zoning Ordinance; (b) Is consistent with the comprehensive plan; (c) Is compatible with the character of surrounding lands and the uses permitted in the zoning district(s) of surrounding lands; (d) Is configured to minimize adverse effects, including the visual impacts of the proposed use on adjacent lands;
