October 28, 2014 <br />Beginning at a point on the north side of Blair Street (formerly B Street) 197 feet west <br />from the northwest intersection of Hatton Street and Blair Street (formerly B Street) and <br />from said point of beginning running thence west along the north side of Blair Street <br />(formerly B Street) 56 feet; thence north and parallel with Hatton Street 116 feet; thence <br />east and parallel with Blair Street (formerly B Street) 56 feet; and thence south and <br />parallel with Hatton Street 116 feet to the point of beginning. <br />BEING all that property conveyed to Richelle Scott by Deed of Bargain and Sale from <br />Fred Alston, Sr. dated August 24, 2005 and recorded in the Portsmouth Circuit Court <br />Clerk's Office as Instrument Number 050017762. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) Days and hours of operation shall be limited to Monday through Friday, between <br />5:00 a. m. and 8:30 p. m. <br />(b) The applicant shall maintain three of the four driveway spaces for the child day <br />care activity during hours of operation. <br />(c) The facility shall be operated in compliance with applicable codes, ordinances <br />and regulations of federal, state and local government and all required licenses and <br />permits shall be obtained and remain in effect during the operation of the Child Day <br />Care Center. <br />(d) All taxes/fees associated with the property and the use shall be paid when due. <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by City Council." <br />14-384 (b): <br />"RESOLUTION GRANTING A USE PERMIT (UP-14-12) TO DAWN RICHARDSON <br />TO OPERATE A BED AND BREAKFAST INN AT 497 NORTH STREET IN THE <br />OLDE TOWNE HISTORIC DISTRICT. <br />WHEREAS, Dawn Richardson, the owner of the subject property, has made <br />application pursuant to Section 40.1-2.3(B) of the Code of the City of Portsmouth, <br />Virginia (2006) for a use permit to operate a Bed and Breakfast Inn at 497 North Street <br />in the Olde Towne Historic District, Portsmouth, Virginia; and <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br />1. That it finds that the use for which the permit is sought: <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br />(b) Is consistent with the comprehensive plan; <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the zoning district(s) of surrounding lands; <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br />
