September 9, 2014 <br />Discussion: <br />• The grant will reimburse 50% of the cost expended for the purchase of bulletproof <br />vests for Portsmouth Police Department and Portsmouth Sheriff Department personnel <br />working on the streets. These funds will offset some of the costs for the future purchase <br />of bulletproof vests for the Portsmouth Police Department. <br />• Bulletproof vests will be purchased with a 50/50 allocation between the General <br />Funds (Police Department's budget, Portsmouth Sheriff Department) and the Grants <br />fund. The revenue from the grantor is a reimbursement to the Grants Fund, which is a <br />multi-year fund. <br />Financial Impact: <br />• The grant award amount is $54,616.47 of the Department of Justice funds for the <br />purchase of bulletproof vests for the Portsmouth Police Department. The matching <br />funds are already in the Portsmouth Police Department's FY 2014/15 General Fund <br />budget. The City has no obligation once the grant has ended. <br />Staff Recommends: <br />• Adoption of an ordinance to appropriate the amount of $54,616.47 to the FY 14- <br />15 Grants Fund from the Department of Justice -Bureau of Justice Assistance. Vision <br />Principles: Quality of Life; Efficient, Responsive Government. <br />Next Steps Following Council Action: <br />• The Chief of Police or his designee will provide grant management and oversight. <br />Motion by Mr. Moody, and seconded by Mr. Meeks, to adopt the following <br />ordinance, and was adopted by the following vote: <br />"ORDINANCE ACCEPTING A GRANT IN THE AMOUNT OF $54,616 FROM THE <br />U.S. DEPARTMENT OF JUSTICE-BUREAU OF JUSTICE ASSISTANCE AND <br />APPROPRIATING SAID FUNDS IN THE FY 2014-15 GRANTS FUND TO PURCHASE <br />BULLETPROOF VESTS FOR PORTSMOUTH POLICE OFFICERS." <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />14 - 339 -Adoption of an ordinance to amend Chapter 31.2 of the Code of the City <br />of Portsmouth, Virginia (2006) to authorize development projects to achieve <br />offsite water quality requirements by the purchase of stormwater mitigation <br />credits outside of the Portsmouth city limits. Vision Principle: Efficient, <br />Responsive Government. <br />Background: <br />• The Virginia stormwater Regulations (9VAC25-870-69) allow for developments <br />to meet phosphorous nutrient reductions offsite within the same hydrologic unit code <br />(HUC), or watershed, adjacent upstream HUC or same tributary regardless of local <br />government boundaries. <br />• The City of Portsmouth stormwater Management ordinance requires <br />development projects to achieve offsite stormwater compliance within our MS4 <br />boundary. <br />Discussion: <br />• The City of Portsmouth was required to adopt a new stormwater ordinance as <br />part of its Virginia stormwater Management Program (VSMP) prior to July 1, 2014 in <br />accordance with new State regulations. Our local ordinance takes a conservative <br />approach in allowing offsite compliance. <br />• The Virginia Department of Environmental Quality has not provided localities with <br />final guidance for implementing offsite stormwater compliance. <br />• Development on physically constrained sites, such as those in the downtown <br />area, may need additional offsite compliance alternatives to meet their water quality <br />requirements for stormwater. The City of Portsmouth desires to encourage economic <br />development by providing design alternatives. <br />• This amendment to our local ordinance remains consistent with State regulations <br />and does not require additional review by the State Water Control Board. <br />
