September 9, 2014 <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that the City Manager is hereby authorized to execute a Deed of Easement to <br />Virginia Electric and Power Company d/b/a Dominion Virginia Power, and to take all <br />other steps necessary to grant the requested easement." <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />14 - 343 -Adoption of a resolution authorizing the City Manager to execute a <br />deed to convey a 30-foot by 850-foot parcel between 3904 and 3920 Burtons <br />Point Road to the Portsmouth Port and Industrial Commission for <br />redevelopment. Vision Principle: A Robust Economy for Working Men and <br />Women. <br />Background: <br />• In conjunction with the Environmental Protection Agency `s (EPA) remediation of <br />the Atlantic Wood Industries (AWI) Superfund Site along the Southern Branch of the <br />Elizabeth River, the City has identified a strip of land that it owns which was once a <br />trolley car easement and reverted by special deed to City. <br />• The City, the Virginia Department of Environmental Protection Agency (DEQ) <br />and EPA have reached tentative agreement to allow EPA to expand the geography of <br />the landfill component of the AWI remediation project to include this strip of land. As a <br />result, the height of the landfill will be reduced and the brownfield development <br />opportunities will be improved. <br />• This property is adjacent to another parcel that is subject to similar agreements, <br />eligible for brownfield development and will be transferred from the Portsmouth Public <br />School Board to the PPIC at a later date. <br />• With its focus on maritime and industrial waterfront development the Portsmouth <br />Port and Industrial Commission (PPIC) is well positioned to market the development <br />opportunity of this and the adjacent parcel. <br />Discussion: <br />• Transfer of this 30-foot strip to the PPIC will consolidate ownership and facilitate <br />redevelopment of the 5-acre larger tract. <br />Financial Impact: <br />• The tentative agreements between the City, EPA and DEQ require the City to <br />provide maintenance of the strip of land until such time as the PPIC sells it for <br />development. While the exact cost of this maintenance is unknown, the benefits of <br />reducing the height of the landfill and creating a brownfield development opportunity far <br />outweigh the costs. <br />Recommended Action: <br />• Adoption of the resolution.
