August 12, 2014 <br />Discussion: <br />• The Department of Criminal Justice Services has made available $544,950 in <br />state general funds for FY 2015 to provide these services locally. <br />• Community Corrections provides a comprehensive array of intermediate <br />sanctions to the local courts as alternatives to incarceration in the city jail. Services <br />include: probation supervision, community service work, restitution, substance abuse <br />assessment, testing and treatment, anger education, domestic violence intervention, <br />and other services as requested by the courts. Between July 1, 2013 and June 30, 2014 <br />the program supervised 357 probationers. They facilitated the collection of $9,042 in <br />restitution to victims, and $10,163 in court costs. Probationers completed 3,632 hours of <br />community service work. Over 63 probationers received conflict resolution and anger <br />education services and 232 received substance abuse services. <br />• Pretrial Services provides supervised release to defendants. Between July 1, <br />2013 and June 30, 2014 the program conducted over 1,352 investigations, screened <br />2,103 defendants, conducted 138 criminal record checks, received 468 placements on <br />supervision and monitored 802 defendants released by the magistrate. <br />Financial Impact: <br />• There is no local match and no obligation for continued funding from the City of <br />Portsmouth once the grant has ended. <br />Recommended Action: <br />• Adoption of ordinance. Vision Principle: Neighborhoods and a Sense of <br />Community. <br />Next Steps: <br />• Program Director to provide grant management and oversight. <br />Motion by Mr. Moody, and seconded by Mr. Meeks, to adopt the following <br />ordinance, and was adopted by the following vote: <br />"ORDINANCE ACCEPTING A GRANT IN THE AMOUNT OF $544,950 FROM THE <br />VIRGINIA DEPARTMENT OF CRIMINAL JUSTICE SERVICES AND <br />APPROPRIATING SAID FUNDS IN THE FY2014-15 GRANTS FUND TO PROVIDE <br />FUNDING TO OPERATE LOCAL PROBATION AND PRETRIAL SERVICES IN THE <br />CITY OF PORTSMOUTH." <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />14 - 292 -Adoption of an ordinance appropriating and authorizing the expenditure <br />of $350,239 in the FY 2014-15 Asset Forfeiture Fund for use by the City for law <br />enforcement purposes. Vision Principle: Efficient, Responsive Government. <br />Background: <br />• The Portsmouth Commonwealth Attorney, Police Department and Sheriff have <br />additional realized balance of funds in both State and Federal Asset Forfeiture accounts <br />in the amount of $350,239. That amount must be appropriated by City Council. <br />Discussion: <br />• The City Commonwealth Attorney, Police Department and Sheriff receive asset <br />forfeiture funds intermittently throughout the year. These amounts must be <br />appropriated by City Council before they can be expended. These funds are treated <br />like grant funds, in that they are restricted as to use, require annual reporting to the <br />granting agencies, and unspent appropriations will carry over from year to year until the <br />original allocation of funds are spent. Staff will submit an appropriation request to City <br />Council whenever any of these offices receives new asset forfeiture funds, just as we do <br />with grant funds. <br />Financial Impact: <br />• Both the revenue and expenditure budgets for the Asset Forfeiture Fund will be <br />increased by $350,239. <br />
