<br />At a Regular Meeting of the City Council on Tuesday, June 10, 2014, there were
<br />present:
<br />Mayor Kenneth I. Wright, Vice Mayor Paige D. Cherry, William E. Moody, Jr., Marlene
<br />W. Randall, Elizabeth M. Psimas, Dr. Curtis E. Edmonds, Sr., Danny W. Meeks, City
<br />Manager John L. Rowe, Jr., City Attorney George M. Willson.
<br />Reverend Joseph Cailles opened the meeting with prayer, which was followed by
<br />the Pledge of Allegiance to the Flag.
<br />Mayor Wright called the meeting to order and welcomed all in attendance.
<br />Motion by Mr. Moody, and seconded by Ms. Randall, to approve the minutes of a
<br />Called Meeting May 27, 2014, and of a Regular Meeting of May 27, 2014, and was
<br />adopted by the following vote:
<br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright
<br />Nays: None
<br />- Mayor Wright recognized the induction of Willard Moody into the Trial Lawyers Hall
<br />of Fame.
<br />- Public Hearing -
<br />14 - 216 -Public hearing on use permit, code amendment, street name change, and
<br />street closure applications:
<br />(a) UP-14-07 MIDTOWN MARKETPLACE- Nathan A. Lahy, with MSA, P.C., on
<br />behalf of Wendy's Restaurant, requests a use permit to construct a
<br />restaurant with adrive-through facility on approximately 1.0 acres
<br />at 1409 Frederick Boulevard. The property is owned by the City of
<br />Portsmouth Economic Development Authority, is zoned General
<br />Mixed Use (GMU). The Comprehensive Plan's Generalized Future
<br />Land Use Map designates this property for commercial use and is
<br />located in the Midtown Regional Activity Center. Vision Principle: A
<br />Robust Economy for Working Men and Women.

<br />Motion by Ms. Psimas, and seconded by Mr. Edmonds, to concur with the
<br />recommendation of the Planning Commission that UP-14-07 be approved, and was
<br />adopted by the following vote:
<br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright
<br />Nays: None
<br />(b) UP-14-09 MIDTOWN MARKETPLACE- Michael A. Culpepper, on behalf of
<br />CRES E. G. Development Group, requests a use permit to allow
<br />two restaurants with two drive-through facilities at each end of a
<br />strip commercial building containing 9,000 square feet located at
<br />1409 Frederick Boulevard. The property is owned by the City of
<br />Portsmouth Economic Development Authority, is zoned General
<br />Mixed Use (GMU). The Comprehensive Plan's Generalized Future
<br />Land Use Map designates this property for commercial use, and it is
<br />located in the Midtown Regional Activity Center. Vision Principle: A
