May 27, 2014 <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the zoning district(s) of surrounding lands; <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br />(f) Maintains safe and adequate egress and ingress onto the site, and safe road <br />conditions around the site; <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in the zoning districts; and <br />(h) Complies with all other city, state, and federal laws and regulations. <br />2. That Theresa Cox-Ford is hereby granted a use permit pursuant to <br />Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for a Family <br />Child Day Care Home at 603 Hansen Avenue, Portsmouth, Virginia, and being more <br />particularly described as: <br />U P-14-04 <br />603 Hansen Avenue <br />ALL THAT certain lot, piece or parcel of land, with the buildings and improvements <br />thereon, situated, lying and being in the City of Portsmouth, Virginia, and being known, <br />numbered and designated as Lots 1, 3, 5 and 7, Block 4, as shown on that certain plat <br />entitled "West Tristan" Portsmouth, Virginia", which said plat is duly recorded in the <br />Clerk's Office of the City of Chesapeake, VA, in Map Book 20 at Page 7. <br />BEING all that certain property conveyed to Thomas D. Ford and Theresa D. Cox-Ford <br />by Deed of Gift from Theresa D. Cox-Ford (f/k/a Theresa D. Cox) dated October 17, <br />2006 and recorded in the Clerk's Office of the Circuit Court for the City of Portsmouth, <br />Virginia as Instrument Number 060023818. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) Days and hours of operation shall be limited to Monday through Friday no earlier <br />than 5:00 a. m. to no later than 8:30 p. m. <br />(b) The applicant shall create three (3) additional off-street parking spaces on the <br />property in order to comply with Portsmouth City Code Section 40.1-5.1 Off-Street <br />Parking, Loading and Circulation. A total of four (4) off-street parking spaces shall be <br />maintained during the facility's days and hours of operation to accommodate one (1) <br />space for the full-time staff member and three (3) spaces for the drop off/pick up of <br />children. <br />(c) The applicant's proposed vehicle use area shall comply with Portsmouth City <br />Code Section 40.1-5(G)(3) Vehicular Use Area Demarcation. The applicant shall <br />submit a site plan that complies with Section 40.1-5(G)(3) for approval by the Zoning <br />Administrator. <br />(d) The facility shall be operated in compliance with applicable codes, ordinances <br />and regulations of federal, state and local government and all required licenses and <br />permits shall be obtained and remain in effect during the operation of the Family Child <br />Day Care Home. <br />(e) All taxes/fees associated with the property shall be paid when due. <br />
