This use permit is approved subject to the following zonditions: (a) No more than ten (10) adults may be residents of the acility at any one time. (b) A minimum of twenty-two (22) parking spaces must be ~rovided. (c) A site plan must be submitted to the Planning staff utlining the exterior recreation and the screening of the parking lot and church from abutting properties in accordance with §40-48 o .he City Code. (d) The parking area must be improved in order to assure ~ompliance with the requirements of 940-49 of the City Code. (e) The applicant shall comply with all applicable codes )rdinances, policies and regulations of federal, state, and local overnments and shall obtain all necessary llcenses and permits pri to commencement of operations." (b) "A RESCLUTION GRANTING A USE PERMIT TO THE NEW MT. VERNON BAPTIST CHURCH TO OPERATE A CHURCH AND PLACE OF WORSHIP AT 3547 VICTORY BOULEVARD. WHEREAS, Sweetbriar Development Corporation has made applica- tion on behalf of the New Mt. Vernon Baptist Church pursuant to ~0~71 (b) of the Code of the City of Portsmouth, Virginia, 1973, the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of a use permit with conditions for the operation of a church and ~lace of worship. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of :smouth, Virginia: 1. That the use for which the use permit he is sought: (a) Will not adversely affect the health and safety of residing or working ~n the neighborhood of the proposes use (b) Will not be detrimental to the public use or injuriou o the property and improvements in the neighborhood; and (c) Will be in accordance with the purposes of the Zoning %hapter of the City Code. 2. The New Mt. Vernon Baptist Church is hereby granted a use ~ermit pusuant to §40-71 (b) of the Code of the City of Portsmouth, ~irginia, to operate a church and place of worship on property des- ignated as 3547 Victory Boulevard which consists of approximately 2.59 acres of land and is described as Tax Map #532, Parcel#52 'UP-87-8). 3.
