295 <br /> <br />April 28, 1987 <br /> <br />ltilites, repair and repIace plumbing fixtures and drywall, con- <br />struct shelving, purcha's'ea storage shed, construct a fence and <br />acquire tools and equipment for yard maintenance; and <br /> <br /> WHEREAS, the application requests nineteen thousand thirty <br />($19,030) dollars in federal funds for repair and maintenance and <br />a one for one local match will be provided from the HER Shelter <br />aperating budget. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that the City Manager be, and he hereby is, <br />~uthorized to submit an application for an Emergency Shelter Care <br />~rogram Grant on behalf of the HER Shelter and to execute any <br />tocuments as may be required thereby. <br /> <br /> BE IT FURTHER RESOLVED that the Council of the City of Por <br />Tirginia authorizes the awarding of a sub-grant to the HER Shelter <br />to operate the funded projec~ and agrees to monitor and oversee <br />their activities as prescribed by the grant." <br /> <br /> Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Holley <br /> Nays: None <br />Abstaining: Webb <br /> <br /> 87-182 On motion of ~rs. Webb and seconded by ~{r. Gray, the <br />following resolutaon was adopted, and by the following vote: <br /> <br />"A RESOLUTION OF THE COUNCIL OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, AGREEING TO PAY SEVENTY-FIVE PERCENT OF <br />ADDITIONAL GARAGE COSTS ARISING FROM THE DEVELOPMENT <br />AGREEMENT ENTERED INTO BY THE CITY OF PORTSMOUTH, <br />PORTSMOHTK REDEVELOPMENT AND HOUSING AUTHORITY AND <br />MASTER DEVELOPMENT CORPORATION. <br /> <br /> WHEREAS, the City of Portsmouth, Virginia, the Portsmouth <br />~edevelopment and Housing Authority, and Master Development <br />Corporation entered into a Development Agreement dated August 13, <br />1985, a First Amendment to Development Agreement dated March 11, <br />1986, and a Second Amendment to Development Agreement dated July 25 <br />1986, and a Third Amendment to Development Agreement dated SeF <br />30, 1986 providing for the purchase and development of a certain <br />parcel of waterfront property lying adjacent to RiverfrontPark for <br />the development of a high rise condominium apsrBnent and commercial <br />building and an adjacent parking garage; and <br /> <br /> WHEREAS, the Development Agreement, as amended, provides that <br />the City and the Authority, jointly and severally, agree to pay to <br />the developer seventy-five percent (75%) of all costs and expenses, <br />ap to the sum of six hundred and thirty-seven thousand, five <br />hundred dollars ($637,500) actually .incurred by the developer in <br />:onnection with the construction of the garage; and <br /> <br /> WH~RF~AS~ the Development Agreement, as amended, further ? <br />that in the event it shall become apparent that the total garage <br />cost will exceed the sum of eight hundred fifty thousand dollars <br />($850,000] the City shall determine by Resolutian of the City <br />Council whether to pay seventy-five ~ercent (75%) of the additional <br />garage cost after receiving notice f~om the developer that the total <br />garage cost will exceed the agreed upon sum; and <br /> <br /> WHEREAS, the developer has notified the City that the total <br />[arage cost wilt exceed the sum of eight hundred fifty thousand <br />dollars ($850,000) by an additional fifty thousand dollars ($50,000) <br />and has requested that the City assume the obligation for its pro <br />share of said fifty thousand dollars ($50,000) bring its total cost <br />and expense of the City up to six hundred seventy-five thousand <br />~$675,000); and <br /> <br />** see 2~5A <br /> <br /> <br />
