That Ofelia Godwin is hereby granted a use permit pursuant to Section 40.1- <br />2.3(6) of the Code of the City of Portsmouth, Virginia (2006) for the operation of a family <br />child day care home at 5927 Eagle Point, and being more particularly described as: <br />UP-13-12 <br />5927 Eagle Point <br />Beginning at a point 89.14'± west of the southwest corner of Heron Point and Eagle <br />Point; thence, in a westerly direction 84.90'± to a point; thence, a southerly direction <br />120.67'± to a point; thence, in a southeasterly direction 38.42'± to a point; thence, in a <br />northeasterly direction 27.85'± to a point; thence, in a northeasterly direction 60.87'± to <br />a point; thence, in a northerly direction 82.07'± to a point of the beginning. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) Days and hours of operation shall be Monday through Friday from 6:30 a.m. to <br />8:30 p.m. <br />(b) Four off-street parking spaces shall be maintained within the applicant's driveway <br />during the facility's days and hours of operation to accommodate one space for the full- <br />time staff member and three spaces for the drop off/pick up of children. <br />(c) The facility shall be operated in compliance with applicable codes, ordinances <br />and regulations of federal, state and local government, and all required licenses and <br />permits shall be obtained and remain in effect during the operation of the family child <br />day care home. <br />(d) All taxes and fees associated with the property shall be paid when due. <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />- City Manager's Report - <br />13 - 399 -Adoption of an ordinance accepting a grant in the amount of $73,140 <br />from the Virginia Department of Social Services and appropriating said funds in <br />the FY 2013-14 Grants Funds for use by the Portsmouth Department of Social <br />Services to assist in securing employment for clients with multiple employment <br />barriers. Vision Principles: Neighborhoods and a Sense of Community, Quality of <br />Life and Lifelong Learning Community. <br />Background: <br />• The Commonwealth of Virginia via the Department of Social Services has <br />awarded grants for Employment Advancement for Temporary Assistance to Needy <br />Families (TANF) participants. The City of Portsmouth Department of Social Services <br />(PDSS) is asub-recipient of grant funds awarded to the Virginia Beach Department of <br />Human Services in an aggregate amount of $295,368. The amount allocated to PDSS <br />is $73,140. <br />• PDSS has been a grant recipient and participant in this program since 2001. <br />
