Background: • In accordance with Section 33.1-41.1 of the Code of Virginia, the Virginia Department of Transportation (VDOT) makes street payments per lane mile to cities and certain towns for use in the maintenance, construction and reconstruction of locally maintained roadways. • The General Assembly included language in the 2007 Appropriations Act authorizing the Commonwealth Transportation Board (CTB) to make payments in lieu of taxes (PILOT) to jurisdictions in which the Virginia Port Authority owns tax exempt real estate Discussion: • The street payment to the City of Portsmouth this fiscal year is $11,181,738. The PILOT for Portsmouth this fiscal year is $201,030. • The total payment from the Virginia Department of Transportation is $11,382,768. • In the City of Portsmouth adopted FY 2013-14 budget, the revenue from VDOT is estimated at $11,083,872. • The actual revenue from VDOT exceeds the budget estimate by $298,796. • The VDOT disperses these funds to the City of Portsmouth on a quarterly basis. These funds may only be utilized on maintenance and improvements within the City rights of way. Financial Impact • The $298,786 increase in funding will be included in the Public Works budget for the street overlay program in the FY2013-14 Operating Budget. Recommended Action: • Adoption of an ordinance. Vision Principle: Neighborhoods and a Sense of Community. Next Steps Following Council Action: • Proceed with the FY2013-14 Operation budget with the inclusion of the subject funds. Motion by Ms. Psimas, and seconded by Mr. Moody, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE TO APPROPRIATE $298,796 IN THE FY 2013-14 GENERAL FUND IN MONIES RECEIVED FROM THE VIRGINIA DEPARTMENT OF TRANSPORTATION FOR ROAD MAINTENANCE."
