March 12, 2013 <br />WHEREAS, the Commonwealth Transportation Board has established <br />procedures for allocation and distribution of funds provided; and <br />WHEREAS, a resolution expressing Portsmouth City Council's continuing <br />support of the application has been requested by the Norfolk and Portsmouth Belt Line. <br />NOW, THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia, that it hereby supports the application of the Norfolk and Portsmouth Belt Line <br />to the Virginia Department of Rail and Public Transportation for Rail Preservation <br />Program funds to be used for its crosstie replacement improvement project." <br />Ayes: Cherry, Edmonds, Meeks, Moody, Psimas, Randall, Wright <br />Nays: None <br />13 - 120 -Adoption of a resolution authorizing the Department of Public Utilities <br />to exceed by 25% or more, the contract with Wiley/Wilson for the Portsmouth <br />Dams Alteration Designs. Vision Principle: Efficient, Responsive Government. <br />Background: <br />• The City, through its Department of Public Utilities, owns and operates three <br />earthen dams as part of a network of lakes that serve as the City's water supply. These <br />dams are located in the City of Suffolk and form Lakes Cahoon, Kilby and Speights <br />Run. These are three of the four lakes that provide drinking water to the City. <br />• Updated dam safety regulations require certain improvements to be made to <br />these three earthen dams to help prevent possible erosion or dam failure. <br />• A Preliminary Engineering Report (PER) was prepared by Wiley~Wilson in <br />September 2010. The PER addressed the improvements needed to bring the earthen <br />dams into compliance with the updated safety regulations. The estimated construction <br />cost of these improvements is between $3.9 million and $4.4 million. <br />• The Department of Conservation (DCR) recently revised their recommended <br />processes to show compliance with the new regulations. <br />Discussion: <br />• Wiley~Wilson has performed additional surveys and flood modeling of the <br />properties impacted by a potential dam failure. This work was performed as a result of <br />the recently revised DCR recommendations. In addition, actual lake level data from <br />Hurricane Floyd in 1999 was compared with potential dam failure models. Coupled with <br />extensive discussions with DCR, the result of this work by Wiley~Wilson has reduced the <br />extent of the improvements required at the earthen dams. <br />Financial Impact: <br />• Approval of the Resolution and subsequent change orders will add approximately <br />$40,500 in additional expense to this project. <br />o Including previous change orders, the original contract amount will <br />increase approximately 49%, from $138,235.00 to $206,040.00. <br />• With the additional work performed by the Engineer, the new construction <br />estimates are between $2.8 million and $3.3 million, a total potential construction <br />savings of $1.1 million. <br />• Funds for these dam improvements are available in the Public Utilities Capital <br />Budget and will fund this additional expense. <br />Recommended Action: <br />Adoption of the resolution. Vision Principle: Efficient, Responsive Government. <br />Next Steps following City Council Action: <br />• Project design will be completed to comply with all DCR design and safety <br />standards and finished construction documents will be sent out for bid. <br />Motion by Mr. Moody, and seconded by Ms. Psimas, to adopt the following <br />resolution, and was adopted by the following vote: <br />
