November 27, 2012 <br />WHEREAS, Jobs Venture, LLC, has made application pursuant to Section <br />40.1-2.3 B of the Code of the City of Portsmouth, Virginia (2006) for the granting of a <br />use permit for the operation of an entertainment establishment with a lounge and live <br />entertainment at 611 Airline Boulevard, Portsmouth, Virginia, which address includes <br />601 Airline Boulevard and 1412 and 1414 Hamilton Avenue; and <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br />1. That it finds that the use for which the permit is sought: <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br />(b) Is consistent with the comprehensive plan; <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the subject property's zoning district; <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br />(f) Maintains safe and adequate egress and ingress onto the site and safe road <br />conditions around the site; <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in their zoning district(s); <br />(h) Complies with all other city, state, and federal laws and regulations. <br />2. That Jobs Venture, LLC, is hereby granted a use permit pursuant to <br />Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for the <br />operation of an entertainment establishment at 611 Airline Boulevard, Portsmouth, <br />Virginia, which address includes 601 Airline Boulevard and 1412 and 1414 Hamilton <br />Avenue, and is more particularly described as: <br />611 Airline Boulevard <br />601 Airline Boulevard <br />1412, 1414 Hamilton Avenue <br />Beginning at a point approximately 70 feet northeast of the southeast corner of the <br />intersection of Potomac Avenue and Airline Blvd, then on the same bearing of <br />N43°24'35"E for a distance of151.14 feet along the right-of-way of Airline Blvd., then <br />S88°19'25"E for 42.32 feet, then S00°23'25"E for 105.51 feet, then S88°19'25"E for <br />98.00 feet, S00°23'25" for 136.50 feet along the right-of-way of Hamilton Avenue, then <br />N88°19'25"W for 98.00 feet along the right-of-way of Watson Street, then N00°23'25"W <br />for 55.36 feet, then N88°45'13"W for 64.89 feet, then N47°07'01"W for 112.68 feet to the <br />point of beginning, and also referenced as Tax Map 300, Parcels 17, 18, 20 and 21. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicants and any successor in interest: <br />
