November 27, 2012 <br />(a) The proposed complies with the applicable standards of the City Zoning <br />Ordinance; <br />(b) The proposed use is consistent with the comprehensive plan; <br />(c) The proposed use is compatible with the character of surrounding lands and the <br />uses permitted in the zoning district(s) of surrounding lands; <br />(d) The proposed use is configured to minimize adverse effects, including the visual <br />impacts of the proposed use on adjacent lands; <br />(e) The proposed use avoids significant deterioration of water and air resources, and <br />other natural resources; <br />(f) The proposed use maintains safe and adequate egress and ingress onto the site, <br />and safe road conditions around the site; <br />(g) The proposed use allows for the protection of property values and the ability of <br />neighboring lands to develop the uses permitted in the zoning districts; and <br />(h) The use complies with all other city, state, and federal laws and regulations. <br />2. That all conditions originally imposed on the subject property are repealed. <br />The applicant and any successor in interest shall be subject to the following conditions: <br />(a) The applicant shall be responsible for the cost of establishing and/or upgrading <br />the necessary utilities. <br />(b) The applicant shall adhere to the approved trash handling plan which includes <br />private trash pickup. <br />(c) All taxes and fees associated with the proposed project shall be paid when due. <br />3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40.1-2.3 of the Code of the City of Portsmouth, Virginia (2006), the housing use permit <br />shall expire for any portion of the approved project for which building permits have not <br />been issued if the applicant fails to apply for all building permits for the entire project <br />within two years of the adoption of this resolution. <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Wright <br />Nays: Whitehurst <br />Motion by Mr. Whitehurst, and seconded by Mr. Cherry, to deny Item 12-439(D), <br />denied on first reading at the November 13, 2012 meeting, and was adopted by the <br />following vote: <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br />Motion by Mr. Moody, and seconded by Mr. Heretick, to adopt the following <br />resolution approved on first reading at the November 13, 2012 meeting, and was <br />adopted by the following vote: <br />12-439(E): <br />"RESOLUTION GRANTING A USE PERMIT (UP-12-14) TO JOBS VENTURE, LLC, <br />TO OPERATE AN ENTERTAINMENT ESTABLISHMENT AT 611 AIRLINE <br />BOULEVARD. <br />
