November 13, 2012 <br />Ayes: Heretick, Randall, Wright <br />Nays: Cherry, Moody, Whitehurst <br />12 - 442 -Adoption of a resolution authorizing the City Manager to sign a license <br />granting the City of Suffolk permission to use a portion of City-owned property <br />for certain public facilities. Vision Principle: Efficient, Responsive Government. <br />Background: <br />• The City of Portsmouth owns certain tracts of property within the corporate limits <br />of the City of Suffolk as part of Portsmouth's watershed and public water supply. <br />• Portsmouth has previously granted Suffolk a license to locate a wastewater <br />pump station on a portion of our property on Manning Road. <br />• Suffolk needs to use additional property to construct a larger pump station in <br />order to handle increased flows and help prevent overflows in this area. <br />Discussion: <br />• A larger pump station that will better handle flows and prevent overflows is <br />advantageous to Portsmouth in protecting our watershed. <br />• The license is revocable and Portsmouth can require removal of facilities should <br />that be necessary in the future. <br />Financial impact: <br />• No City funds are involved. <br />Recommended Action: <br />• Adoption of the resolution. Vision Principle: Efficient, Responsive Government. <br />Next Steps Following Council Action: <br />• Execution of the License by the City Manager. <br />Motion by Mr. Whitehurst, and seconded by Mr. Heretick, to adopt the following <br />resolution, and was adopted by the following vote: <br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A LICENSE <br />GRANTING PERMISSION TO THE CITY OF SUFFOLK TO USE A PORTION OF <br />CITY-OWNED PROPERTY FOR CERTAIN PUBLIC FACILITIES. <br />WHEREAS, the City of Portsmouth owns certain tracts of property within the <br />corporate limits of the City of Suffolk ("Suffolk") as part of Portsmouth's watershed and <br />public water supply <br />WHEREAS, the City has previously granted Suffolk a license to locate a <br />wastewater pump station on a portion of our property on Manning Road. <br />WHEREAS, Suffolk needs to use additional property to construct a larger pump <br />station in order to handle increased flows and help prevent overflows in this area. <br />WHEREAS, a larger pump station that will better handle flows and prevent <br />overflows is advantageous to the City of Portsmouth in protecting our watershed. <br />WHEREAS, the Director of Public utilities recommends that Suffolk be granted a <br />revocable license for the construction of the pump station. <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it hereby authorizes the granting of a revocable license to the City of <br />Suffolk to construct a larger wastewater pump station on Portsmouth's property on <br />Manning Road. <br />BE IT FURTHER RESOLVED that the Acting City Manager or his designee is <br />authorized to execute the appropriate documents granting the revocable license and to <br />take such additional actions as are necessary to accomplish the purpose stated in this <br />resolution." <br />
