November 13, 2012 Ayes: Heretick, Randall, Wright Nays: Cherry, Moody, Whitehurst 12 - 442 -Adoption of a resolution authorizing the City Manager to sign a license granting the City of Suffolk permission to use a portion of City-owned property for certain public facilities. Vision Principle: Efficient, Responsive Government. Background: • The City of Portsmouth owns certain tracts of property within the corporate limits of the City of Suffolk as part of Portsmouth's watershed and public water supply. • Portsmouth has previously granted Suffolk a license to locate a wastewater pump station on a portion of our property on Manning Road. • Suffolk needs to use additional property to construct a larger pump station in order to handle increased flows and help prevent overflows in this area. Discussion: • A larger pump station that will better handle flows and prevent overflows is advantageous to Portsmouth in protecting our watershed. • The license is revocable and Portsmouth can require removal of facilities should that be necessary in the future. Financial impact: • No City funds are involved. Recommended Action: • Adoption of the resolution. Vision Principle: Efficient, Responsive Government. Next Steps Following Council Action: • Execution of the License by the City Manager. Motion by Mr. Whitehurst, and seconded by Mr. Heretick, to adopt the following resolution, and was adopted by the following vote: "RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A LICENSE GRANTING PERMISSION TO THE CITY OF SUFFOLK TO USE A PORTION OF CITY-OWNED PROPERTY FOR CERTAIN PUBLIC FACILITIES. WHEREAS, the City of Portsmouth owns certain tracts of property within the corporate limits of the City of Suffolk ("Suffolk") as part of Portsmouth's watershed and public water supply WHEREAS, the City has previously granted Suffolk a license to locate a wastewater pump station on a portion of our property on Manning Road. WHEREAS, Suffolk needs to use additional property to construct a larger pump station in order to handle increased flows and help prevent overflows in this area. WHEREAS, a larger pump station that will better handle flows and prevent overflows is advantageous to the City of Portsmouth in protecting our watershed. WHEREAS, the Director of Public utilities recommends that Suffolk be granted a revocable license for the construction of the pump station. NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that it hereby authorizes the granting of a revocable license to the City of Suffolk to construct a larger wastewater pump station on Portsmouth's property on Manning Road. BE IT FURTHER RESOLVED that the Acting City Manager or his designee is authorized to execute the appropriate documents granting the revocable license and to take such additional actions as are necessary to accomplish the purpose stated in this resolution."
