September 25, 2012 <br />WHEREAS, the EDA has requested, by resolution dated September 18, 2012, <br />that the City enter into a Cooperation Agreement, attached hereto and made a part <br />hereof, that will provide a method of funding to the EDA for the North Pier site <br />improvement; and <br />WHEREAS, the proposed North Pier site development is consistent with the <br />City's comprehensive and area master plans and will bring an influx of new residents <br />to Downtown and have a beneficial fiscal impact, including the conversion of an <br />untaxed vacant parcel into a taxable and attractive income-producing property. <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia that the City Manager is hereby authorized to execute the <br />attached Cooperation Agreement with the Economic Development Authority of the City <br />of Portsmouth, Virginia or an agreement containing terms substantially similar to those <br />recited above." <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br />12 - 395 -Boards and Commissions <br />There were no appointments. <br />12 - 396 -Items Submitted by Council Members <br />Adoption of an ordinance to amend Chapter 4 of the Code of the City of <br />Portsmouth, Virginia (2006) by amending Section 4-9 thereof pertaining to the <br />tethering of animals. Deferred from the September 11, 2012 City Council Meeting. <br />1. Mark Geduldig-Yatrofsky, P. O. Box 50141, asked that there be a full discussion in <br />the community to give everyone that will be affected an opportunity to voice their <br />opinions. <br />2. Erica Nestler, 413 Douglas Avenue, spoke in support of this item. <br />Motion by Mr. Moody, and seconded by Mr. Edmonds, to adopt the following <br />ordinance to include changing the word "cumulative" to "consecutive", and was adopted <br />by the following vote: <br />"ORDINANCE TO AMEND CHAPTER 4 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 4-9 THEREOF <br />PERTAINING TO THE TETHERING OF ANIMALS." <br />
