September 11, 2012 "RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN EASEMENT TO COLUMBIA GAS OF VIRGINIA, INC., THROUGH A PORTION OF THE PUBLIC UTILITIES OPERATIONS CENTER ON MEANDER ROAD. WHEREAS, Columbia Gas of Virginia, Inc., ("Columbia Gas") needs to relocate a natural gas main that is in conflict with proposed road improvements at Martin Luther King Boulevard and High Street; and WHEREAS, Columbia Gas proposes to relocate the line on Meander Road along the southern edge of property owned by the City of Portsmouth and used as the Operations Center for the Department of Public Utilities; and WHEREAS, the City of Portsmouth, as owner of record of the subject property, must execute the necessary Deed of Easement. NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that the City Manager is hereby authorized to execute said Deed of Easement to Columbia Gas of Virginia, Inc., and take all other steps necessary to grant the requested easement." Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright Nays: None 12 - 367 -Adoption of a resolution authorizing the City Manager to execute deeds of vacation and release of utility easements in the Highland Biltmore neighborhood. Vision Principle: Efficient, Responsive Government Background: • There are numerous utility easements located on properties within the Highland Biltmore subdivision, many of which are beneath houses built there. • The City has received repeated requests from property owners in Highland Biltmore asking the City to vacate and release portions of utility easements in order to be able to sell, improve, or otherwise use their property as collateral. Discussion: • The Department of Public Utilities has made improvements in recent years to relocate utility lines out of individual properties and into the public right-of-way as part of upgrading facilities in the neighborhood. • Adoption of the resolution will allow the City Manager to execute future requests to vacate and release deeds for these easements in order to avoid delay in accommodating property owner requests. Financial impact: • No City funds are involved. Recommended Action: • Adoption of the resolution. Vision Principle: Efficient, Responsive Government. Next Steps Following Council Action: • As future requests are received, the City Manager will execute necessary releases. Motion by Ms. Randall, and seconded by Mr. Heretick, to adopt the following resolution, and was adopted by the following vote: "RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE DEEDS OF VACATION AND RELEASE OF UTILITY EASEMENTS IN THE HIGHLAND BILTMORE NEIGHBORHOOD. WHEREAS, there are numerous utility easements located on private properties within the Highland Biltmore neighborhood, including some easements under private residences; and
