September 11, 2012 <br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN <br />EASEMENT TO COLUMBIA GAS OF VIRGINIA, INC., THROUGH A PORTION OF <br />THE PUBLIC UTILITIES OPERATIONS CENTER ON MEANDER ROAD. <br />WHEREAS, Columbia Gas of Virginia, Inc., ("Columbia Gas") needs to relocate a <br />natural gas main that is in conflict with proposed road improvements at Martin Luther <br />King Boulevard and High Street; and <br />WHEREAS, Columbia Gas proposes to relocate the line on Meander Road <br />along the southern edge of property owned by the City of Portsmouth and used as the <br />Operations Center for the Department of Public Utilities; and <br />WHEREAS, the City of Portsmouth, as owner of record of the subject property, <br />must execute the necessary Deed of Easement. <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that the City Manager is hereby authorized to execute said Deed of Easement <br />to Columbia Gas of Virginia, Inc., and take all other steps necessary to grant the <br />requested easement." <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br />12 - 367 -Adoption of a resolution authorizing the City Manager to execute <br />deeds of vacation and release of utility easements in the Highland Biltmore <br />neighborhood. Vision Principle: Efficient, Responsive Government <br />Background: <br />• There are numerous utility easements located on properties within the Highland <br />Biltmore subdivision, many of which are beneath houses built there. <br />• The City has received repeated requests from property owners in Highland <br />Biltmore asking the City to vacate and release portions of utility easements in order to <br />be able to sell, improve, or otherwise use their property as collateral. <br />Discussion: <br />• The Department of Public Utilities has made improvements in recent years to <br />relocate utility lines out of individual properties and into the public right-of-way as part of <br />upgrading facilities in the neighborhood. <br />• Adoption of the resolution will allow the City Manager to execute future requests <br />to vacate and release deeds for these easements in order to avoid delay in <br />accommodating property owner requests. <br />Financial impact: <br />• No City funds are involved. <br />Recommended Action: <br />• Adoption of the resolution.
