July 24, 2012 <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The site shall be developed in substantial compliance with the site plan submitted <br />by Horton and Dodd, P. C. dated March 23, 2012, approved by the Director of Planning, <br />and on file in the Department of Planning. <br />(b) The recommendations of the Traffic Impact Analysis dated April 17, 2012, must <br />be installed in whole or in part by the applicant as finally approved by the City Engineer. <br />(c) A minor subdivision eliminating all interior lot lines within the subject property and <br />creating a single parcel must occur prior to site plan approval. <br />(d) All uses on the property shall be operated in compliance with all applicable <br />codes, ordinances, and regulations of federal, state, and local governments. <br />(e) The applicant shall obtain and keep current all required licenses and permits <br />before operation and these licenses and permits shall remain in effect during the <br />operation of the establishment. <br />(f) Taxes and fees associated with the property shall be paid when due. <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br />12-282 (f): <br />"ORDINANCE TO AMEND CHAPTER 40.1 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) TO CLARIFY, CORRECT, AND AMEND CERTAIN <br />PROVISIONS OF THE CITY'S ZONING ORDINANCE." <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br />- City Manager's Report - <br />12 - 300 -Adoption of an ordinance accepting a grant in the amount of $532,829 <br />from the Virginia Department of Criminal Justice Services and appropriating said <br />amount in the FY 2012-13 Grants Fund for probation and pretrial services in the <br />City of Portsmouth. Vision Principle: Neighborhoods and a Sense of Community. <br />Background: <br />• The Community Corrections & Pretrial Services Program has been continually <br />funded by the state since 1995. It is a diversion from incarceration program. <br />• This state funding allows us to provide quality supervision to non-violent <br />offenders and defendants in the community and directly impact the jail population. <br />Discussion: <br />• The Department of Criminal Justice Services has made available $532,829 in <br />state general funds for FY 2013 to provide these services locally. <br />• Community Corrections provides a comprehensive array of intermediate <br />sanctions to the local courts as alternatives to incarceration in the city jail. Services <br />include: probation supervision, community service work, restitution, substance abuse <br />assessment, testing and treatment, anger education, domestic violence intervention, <br />and other services as requested by the courts. Between July 1, 2010 and June 30, 2011 <br />the program served 434 Portsmouth citizens. They facilitated the collection of $15,717 <br />in restitution to victims, and $13,533 in court costs. Offenders completed 4,453 hours of <br />community service work. Over 61 offenders received conflict resolution and anger <br />education services and 270 received substance abuse services. We are actively <br />involved in the implementation of evidenced based practices in our agency. <br />
