July 10, 2012 <br />WHEREAS, the new South Norfolk Jordan Bridge will connect the cities of <br />Portsmouth and Chesapeake ("Cities") for vehicular and pedestrian traffic; and <br />WHEREAS, the National Incident Management Systems recommends that public <br />safety response resources, coordination and incident management be the subject of <br />agreements outlining the responsibilities of each party with respect to public safety <br />incidents; and <br />WHEREAS, the Cities deem it in their best interests to enter into such an <br />agreement with South Norfolk Jordan Bridge, LLC, the owner of the new bridge; and <br />WHEREAS, the Cities also deem it in their best interests to enter into a <br />Memorandum of Understanding between the Cities outlining the role of each city with <br />respect to public safety resources, coordination, and responses. <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that the City Manager is hereby authorized to execute (a) an agreement with <br />South Norfolk Jordan Bridge, LLC, and (b) a Memorandum of Understanding with the <br />City of Chesapeake under such terms as he shall deem in the best interests of the City <br />of Portsmouth, outlining the rights and responsibilities of each party regarding public <br />safety incidents involving the new South Norfolk Jordan Bridge. <br />BE IT FURTHER RESOLVED that the City Manager is hereby authorized to <br />enter into such additional agreements and provide such additional assurances as he <br />deems necessary to accomplish the purposes of this resolution." <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br />- New Business - <br />12 - 284 -Boards and Commissions <br />There were no appointments. <br />12 - 285 -Items Submitted by Council Members <br />Motion by Mr. Heretick, and seconded by Mr. Whitehurst, to amend, revise and <br />expand the agenda so as to take up a resolution concerning an unsolicited proposal <br />from APM Terminals to lease and operate the Port of Virginia, and was adopted by the <br />following vote: <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br />Motion by Mr. Heretick, and seconded by Mr. Whitehurst to adopt the following <br />resolution and was adopted by the following vote: <br />"RESOLUTION CONCERNING AN UNSOLICITED PROPOSAL FROM APM <br />TERMINALS TO LEASE AND OPERATE THE PORT OF VIRGINIA. <br />WHEREAS, the existence of the Port of Virginia was brought about when <br />Governor Holton and the General Assembly of Virginia consolidated the independent <br />ports of Portsmouth, Norfolk, and Newport News in the early 1970's, and <br />WHEREAS since then, the Port of Virginia has been owned and operated by the <br />Virginia Port Authority, and today the port is the most valuable publicly owned asset in <br />the Commonwealth of Virginia, contributing immeasurably year after year to state tax <br />revenues and business profitability, business growth, and employment throughout the <br />Commonwealth, and <br />
