February 28, 2012 <br />WHEREAS, the Portsmouth Redevelopment and Housing Authority (the <br />"Housing Authority"), acting at the City's request and with cooperation and support from <br />the City's Management Team, and as legally authorized by Section 36-19 of the Code <br />of Virginia and other applicable laws, has negotiated a Development Agreement with <br />the Developer to bring about said redevelopment (the "Development Agreement"), and <br />WHEREAS, the residences will all be single-family homes of a size and quality to <br />be beneficial to all nearby neighborhoods, and <br />WHEREAS, the new residents who will ultimately occupy this development will <br />provide a demographic base to help increase the amount, diversity, and quality of retail <br />shopping for all residents in the area, and <br />WHEREAS, this development is anticipated to be an "anchor" community that will <br />stabilize and upgrade the quality of life in this entire region of the City, and <br />WHEREAS, the Developer proposes to construct, with City financial support, a <br />replacement recreation and community center located at the present Cradock Middle <br />School (the "New Recreation Center"), to replace the present recreation and community <br />center and thereby meet the community's needs, and <br />WHEREAS, the Portsmouth School Board has approved the conceptual design <br />and location for the New Recreation Center, and <br />WHEREAS, in order for the Development Agreement to be implemented, it will <br />necessary for the City to enter into a Cooperation Agreement with the Housing Authority <br />(the "Cooperation Agreement"), <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia that: <br />1. The City Council, acting for and on behalf of the City of Portsmouth, hereby <br />finds and determines that the redevelopment of Cradock High School as contemplated <br />by the Development Agreement is in the public interest, and the Housing Authority is <br />hereby authorized and requested to execute and implement the Development <br />Agreement and to proceed with redevelopment thereunder. <br />2. The City Manager, acting for and on behalf of the City, is hereby authorized <br />and directed to execute and deliver a Cooperation Agreement substantially the same as <br />that which is attached to this resolution, which shall be approved as to form and legality <br />by the City Attorney. <br />3. The City Manager and City Attorney are further authorized and directed to <br />give such other assurances, to execute such other instruments, including without <br />limitation a deed or deeds conveying the Property and/or any other needed easements <br />or interests to the Housing Authority, and to provide additional cooperation and <br />assistance, all as may be reasonably necessary to implement the intent of this <br />resolution and the Development Agreement, in order to bring about the proper <br />development of the Property by the Developer. <br />4.
