446 <br /> <br />September 8, 1987 <br /> <br /> Vice Mayor Webb chai~ed,the meeting.for Mayor Holley to make <br />the following statement: <br /> <br /> Mayor Holley requested the City Manager and the City Attorney <br />to look at group housing applications in the historic districts and <br />furnish documented information on what has ~ranspired in other plac~ <br />throughout the United States, and after reviewing the findings, may- <br />be Council would reach some conclusion where we would all be ~ogeth~ <br />on the matter. <br /> <br />Mayor Holley return mo the Chair. <br /> <br />UNFINISHED BUSINESS - <br /> <br />87-370 Use permit application: <br /> <br />{a) <br /> <br />Resolution granting a use permit to Portsmouth Children'~ <br />Home, Inc., for the operation of Holiday House of Ports- <br />mouth, Inc., a group home for children at a211 County <br />Street (UP 87-19), approved on first reading at the Publl <br />Hearing of August 25, 1987, was taken up and read. <br /> <br /> On motion of Mr. Barnes and seconded by Mrs. Lucas, the follow~ <br />ing resolution was adopted, and by the following vo~e: - <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO PORTSMOUTH CHILDREN'S <br />HOME, INC. FOR THE OPERATION OF HOLIDAY HOUSE OF PORTSMOUTH, <br />INC., A GROUP HOME FOR CHILDREN AT 4211 COUNTY STREET. <br /> <br /> WHEREAS, Portsmouth Children's Home, Inc. by William H. Oast, <br />III, Attorney, has made application pursuant to ~0-75 (b) of the <br />Code of the City of Portsmouth, Virginia, as amended, for the grant <br />ing of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all <br />things required to be done in connection with said application; and <br /> <br /> WHEREAS, Holiday House has provided services to severely retard <br />ed children and young adults since the eawly 1900's and the curr~en~' <br />facility was established prior to the Use permit requirements for <br />· esidential care facilities within the Residential R-75 Zone; and <br /> <br /> WHEREAS, a use permit is now ~equired in order for the facilit <br />~o construct an activity and therapy cottage on the Site but there <br />will be no additional staff or residents of the facility as a resul <br />of the new structure; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting <br />of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVKD by the~C6uncil of the City.of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not affect the health and safety of persons <br />residing or working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injuriou~ <br />to the property and improvements in the neighborhood; and <br /> <br /> (c) Will be in accordance with the purposes of the Zoning <br />Chapter of the City Code. <br /> <br /> <br />
