June 27,2000 <br /> <br /> · Filin.q of Resolution. The City Attorney shall file a copy of this resolution, <br />certified by the City Clerk of the City to be a true copy thereof, with the Circuit Court <br />of the City of Portsmouth, Virginia, in accordance with Section 15.2-2607 of the <br />Code of Virginia of 1950. <br /> <br /> · Applicable Law. In accordance with Section 15.2-2601 of the Public <br />Finance Act of 1991 (Chapter 26, Title 15.2, Code of Virginia of 1950, as amended) <br />the City Council elects to enter into the Lease pursuant to the provisions of such Act. <br /> <br />· Effective Date. This Resolution shall take effect immediately." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />00 - 148 - Adoption of a resolution authorizing the City Manager to execute a grant of <br />easement to Virginia Power for overhead electric lines along the former right-of-way of <br />Williamsburg Avenue as closed. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution authorizing the City Manager to execute a grant of <br />easement to Virginia Power for overhead electric lines along the former right-of-way of <br />Williamsburg Avenue as closed. <br /> <br />Purpose and Need: <br /> <br />· This easement is needed to provide Virginia Power easement area so that they can <br />maintain in place the main lines serving I.C. Norcom and the surrounding area. Before <br />the closure of Williamsburg Avenue the lines were located in the public right-of-way. <br /> <br />Financial Impact: <br /> <br />· There is no financial impact. If the City required the lines to be moved it is likely the <br />City would face a large bill for such removal and replacement. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY AN <br />EASEMENT TO VIRGINIA POWER FOR OVERHEAD ELECTRIC LINES AND <br />APPURTENANT FACILITIES IN THE AREA OF WILLIAMSBURG AVENUE AS <br />CLOSED AND VACATED. <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City Manager be, and he hereby is, authorized to convey to Virginia Power an easement <br />over, across and adjacent to the former right of way of Williamsburg Avenue under such <br />term and conditions as he shall deem appropriate and in the best interest of the City for <br />the purpose of providing electric power to the surrounding area, and portions of the <br />downtown area." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />00 - 149 - Adoption of a resolution authorizing the City Manager to execute and deliver <br />to the Portsmouth Redevelopment and Housing Authority a Cooperation Agreement for <br />the Tower Redevelopment Project. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution authorizing the City Manager to execute and deliver to the <br />Portsmouth Redevelopment and Housing Authority (PRHA) a Cooperation Agreement <br />for the Tower Redevelopment Project. <br /> <br /> <br />
