October 13, 1987 Motion of Mrs. Lucas and seconded by Mr. Barnes, to concur with the recommendation of the City Manager, and defer the matter to the next regular meeting on October 27, 1987, and was adopted by 5-2 (Nay- Webb & Simpson) Vote. 87-443 Letter fr6m the City Manager recommending adoption a resolution authorizing the City Manager to release a public utilify sewer easement. "In 1979 a Public Utilities Sewer Easement was dedicated by recorded deed on property located at the intersection of Deep Creek Boulevard and Kirby Street, The Director of Public Utilitie~ and the Director of Public Works have indicated that this easement is no longer required for public purposes. The present property owners, Mr. & Mrs. Milton Williams, have requested that the ease- ment be released. I recommend adoption of the resolution authorizing the issuance of a deed of release in this matter." On motion of Mrs. Lucas and seconded by Mrs. Webb, the follow- ing resolution was adopted and by the following vote: "A RESOLUTION AUTHORIZING THE CITY MANACER TO RELEASE A PUBLIC UTILITY EASEMENT AT THE INTERSECTION OF DEEP CREEK BOULEVARD AND KIRBY STREET. WHEREAS, by Deed dated August 31, 1979, recorded in the Deed Book, 765, Page 570 in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia, a Public Utility Sewer Easement was dedicated on the hereinafter described property; and WHEREAS, said easement is no longer required for public purposes; and ~?r WHEREAS, the present owners ~f the subject properyt have requested that the easement be released. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and hereby is, authorized to execute a deed of release f6r a public utility sewer easement at the intersection of Deep Creek Boulevard and Kirby Street, more particularly described as follows, to-wit: All those certain portions of lots 1, 2, 3, 4, and 5 in Block C on the plat of South Highlands, No. 2, recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia, in Map Book 17, Page 76, and designated on the plat attached hereto entitled "plat showing sewer easement located on portion of lots 1 thru 5 Block C. South Highlands No. 2" dated August 9, 1979." Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holl Nays: None 87-444 - Letter from the City Manager recommending adoption of a resolution refunding $1.15 million in Industrial Revenue Bonds originally issued by the Industrial Development Authority to FT Associates to take advantage of the current lower interest rates. "On September 30, 1987, the Industrial Development Authority of the City of Portsmouth held a public hearing on a refunding of an Industrial Revenue Bond in the amount of $1.15 million issued by the Authority in 1983 for the benefit of FT Associates. The bond proceeds were used to construct the Food Lion Shopping Center on High Street and Tyre Neck Road. The purpose of the refunding is to take advantage of the current interest rates which are lower than when the bond was originally financed.
