October 13, 1987 <br /> <br /> Motion of Mrs. Lucas and seconded by Mr. Barnes, to concur <br />with the recommendation of the City Manager, and defer the matter <br />to the next regular meeting on October 27, 1987, and was adopted <br />by 5-2 (Nay- Webb & Simpson) Vote. <br /> <br /> 87-443 Letter fr6m the City Manager recommending adoption <br />a resolution authorizing the City Manager to release a public <br />utilify sewer easement. <br /> <br /> "In 1979 a Public Utilities Sewer Easement was dedicated by <br />recorded deed on property located at the intersection of Deep <br />Creek Boulevard and Kirby Street, The Director of Public Utilitie~ <br />and the Director of Public Works have indicated that this easement <br />is no longer required for public purposes. The present property <br />owners, Mr. & Mrs. Milton Williams, have requested that the ease- <br />ment be released. <br /> <br /> I recommend adoption of the resolution authorizing the <br />issuance of a deed of release in this matter." <br /> <br /> On motion of Mrs. Lucas and seconded by Mrs. Webb, the follow- <br />ing resolution was adopted and by the following vote: <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY MANACER TO RELEASE A <br /> PUBLIC UTILITY EASEMENT AT THE INTERSECTION OF DEEP <br /> CREEK BOULEVARD AND KIRBY STREET. <br /> <br /> WHEREAS, by Deed dated August 31, 1979, recorded in the Deed <br />Book, 765, Page 570 in the Clerk's Office of the Circuit Court of <br />the City of Portsmouth, Virginia, a Public Utility Sewer Easement <br />was dedicated on the hereinafter described property; and <br /> <br /> WHEREAS, said easement is no longer required for public <br />purposes; and ~?r <br /> <br /> WHEREAS, the present owners ~f the subject properyt have <br />requested that the easement be released. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that the City Manager be, and hereby is, <br />authorized to execute a deed of release f6r a public utility <br />sewer easement at the intersection of Deep Creek Boulevard and <br />Kirby Street, more particularly described as follows, to-wit: <br /> <br /> All those certain portions of lots 1, 2, 3, 4, and <br /> 5 in Block C on the plat of South Highlands, No. 2, <br /> recorded in the Clerk's Office of the Circuit Court of <br /> the City of Chesapeake, Virginia, in Map Book 17, Page <br /> 76, and designated on the plat attached hereto entitled <br /> "plat showing sewer easement located on portion of lots <br /> 1 thru 5 Block C. South Highlands No. 2" dated August <br /> 9, 1979." <br /> <br /> Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holl <br /> Nays: None <br /> <br /> 87-444 - Letter from the City Manager recommending adoption <br /> of a resolution refunding $1.15 million in Industrial Revenue <br /> Bonds originally issued by the Industrial Development Authority <br /> to FT Associates to take advantage of the current lower interest <br /> rates. <br /> <br /> "On September 30, 1987, the Industrial Development Authority <br />of the City of Portsmouth held a public hearing on a refunding of <br />an Industrial Revenue Bond in the amount of $1.15 million <br />issued by the Authority in 1983 for the benefit of FT Associates. <br />The bond proceeds were used to construct the Food Lion Shopping <br />Center on High Street and Tyre Neck Road. The purpose of the <br />refunding is to take advantage of the current interest rates which <br />are lower than when the bond was originally financed. <br /> <br /> <br />
