December 13. 2011 Next Steps Following Council Action: . Execution of the Scott Estate and donation to PMF. . City procures and constructs improvements to room funded by PMF. . Department of Museums uses improved room for art programming and for ERAC as specified in MOU. Motion by Mr. Moody, and seconded by Mr. Edmonds, to adopt the following resolution, and was adopted by the following vote: "RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF UNDERSTANDING WITH THE PORTSMOUTH MUSEUMS FOUNDATION ACCEPTING THE DONATION OF FUNDS TO IMPROVE THE PORTSMOUTH ART AND CULTURAL CENTER ANNEX AND APPROVING ITS USE BY THE ELIZABETH RIVER ARTISTS CLUB. WHEREAS, the Estate of Dorothy G. Scott ("Scott Estate") a former member of the Elizabeth River Artists Club ("ERAC") wishes to donate the sum of $90,000 to the Portsmouth Museums Foundation ("Foundation"); and WHEREAS, the Scott Estate desires that an amount not to exceed $12,000 be used by the Foundation to renovate a room in the Portsmouth Art and Cultural Center as a place for the ERAC members to paint and to hold their monthly meetings; and WHEREAS, the Portsmouth Museums have identified a room in the Center Annex that is available for such uses; and WHEREAS, the Foundation and the Portsmouth Museums deem it advisable to enter into a Memorandum of Understanding concerning the use of the funds and the renovated room in the Annex. NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that it hereby expresses its sincere appreciation to the Estate of Dorothy of G. Scott for its generous gift to the Portsmouth Museums Foundation and for designating a portion of the gift to improving the art facility at the Portsmouth Art and Cultural Center. BE IT FURTHER RESOLVED that the City Manager or his designee is authorized to enter into a Memorandum of Understanding with the Portsmouth Museums Foundation outlining the responsibilities of each party with respect to the funds and the use of the renovated room in the Center Annex by the Elizabeth River Artists Club." Ayes: Cherry, Edmonds, Heretick, Moody, Whitehurst, Wright Nays: None 11 - 479 - Adoption of a resolution proposing that Charter amendments requiring a balanced City budget and the creation of an Auditor position to be appointed by the City Council be adopted by the 2012 Virginia General Assembly. Background: . At a special meeting with the Portsmouth State Delegation on October 12, 2011, City Council discussed forwarding several proposed amendments to the current City Charter for approval by the 2012 General Assembly, including the following: o Amend and reenact the Charter formally requiring the City annually adopt a balanced budget. o Amend and reenact the Charter authorizing the City Council to appoint an independent City Auditor, appointed by and reporting solely to Council. . These proposed Charter amendments were included in the Legislative Packet adopted by City Council resolution at its meeting on October 25, 2011.
