November 24; 1987 "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTION 40-140 (c), PERTAINING TO PRESERVATION P-1 DISTRICT DIMENSIONAL REQUIREMENTS.~" (e) "ZONING ORDINANCE AMENDMENT Z 87-22." (f) "A RESOLUTION GRANTING A USE PERMIT TO LAPHTITE ACADEMY, INC. TO OPERATE A CHILD CARE CENTER AT 3907 CEDAR LANE. WHEREAS, Richard K. Stell, on behalf of LaPetite Academy, Inc., has made application pursuant t~ ~40~5 (b) of ~he Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit to operate a child care center at 3907 Cedar Lane; and WHERE~S, the applicant and the Planning Director have done all things-r~quired to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the conditiona'l.Qranting of a use permit for the operation of a care center. child NOW, T~EREFORE, HE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in 'the neighborhood of.~h~ proposed use; (b) will not be detrimental to the public use or injurious to the property or improvements of the neighborhood; and (c) will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. ~ LaPe~ite Academy, Inc. is hereby granted a use permit pursuant to ~40-75 (b) of the Code of the City of Portsmouth, Virginia, 1973, to operate a child care center at 3907 Cedar Lane (Tax Map 721, Parcel 3.1), the activities to be conducted within a facility.to be constructed encompassing 5,465 square feet of building on a 31,798 square foot lot (UP-87-23). 3. This use permit is approved subject to the following conditions: (a) The facility mav be operated with an enrollment of not more than one hundred fifteen (115) children to be cared for at the facility at any one time~ (b) A five foot (5') wood privacy fence shall be installed enclosing a minimum play. area of '10,300 square feet. (c) A five foot (5') wood privacy fence shall be installed around the dumpster area. (d) Ail indoor activities shall be conducted between the hours of 6:30 a. m. and 6:30 p.m.. · (e) Ail outdoor activities shall be conducted between the ~'hours of 8:30 a. m. and 6:00 p..m.. (f) The applicant shall comply with all applicable codes, ordinances, policies and regulations of federal, state and local governments and shall obtain all necessary licenses and permits.
