January 12, 1988 <br /> <br />"AN ORDINANCE TO APPROPRIATE $205,000 FROM THE CAPITAL <br />IMPROVEMENT FUND FOR THE INSTALLATION OF AN AUTOMATIC <br />IRRIGATION SYSTEM AND CONSTRUCTION OF A NEW-PUTTING GREEN <br />AT SLEEPY HOLE GOLF COURSE.'~ <br /> <br /> 88-7 Letter from the City Manager recommending adoption <br />of an ordinance to appropriate $100,000 f~om the Capital <br />Improvement Fund fo~ aerial surveying and engineering design <br />work Highland Biltmore sewers and street improvements. <br /> <br /> "The-1987-92 Capital Improvement Program indicates <br />$168,500 in FY 87-88~for surveying and engineeringldesign of <br />Highland Biltmore. improvements. This project includes. <br />installation of.curbg and gutters, roadway improvements, storm <br />drains, water lines, sewer and related work. At this time, it <br />is necessary to appropriate funds for the aerial surveying and <br />enginee~lng~design. <br /> <br /> The City Engineer recommends appropriation of $100,000 at <br />this time'to initiate this project. Therefore, I concur and <br />recommend appropriation of the necessary funds." <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Simpson, the <br />following ordinance was approved on first reading, and was <br />adopted by unanimous vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $100,000 FROM THE CAPITAL <br />IMPROVEMENT FUND FOR AERIAL SURVEYING AND ENGINEERING <br />DESIGN WORK FOR THE HIGHLAND BILTMORE SEER AND STREET <br />IMPROVEMENT PROGRAM" <br /> <br /> 88~8 Letter from the City Manager recommending adoption <br />of an ordinance to amend Chapter 23 of the City Code by <br />amending Section 23-89(b) pertaining to motor vehicles. <br /> <br /> "The City of Portsmouth Motor Vehicle Code, in accordance <br />with similar provisions of the State Code, provide that any <br />person driving while their license, permit, or privilege to <br />drive has been suspended or revoked, shall be confined in jail <br />as well as fined for such violation. The General Assembly of <br />Virginia has provided for an exception to the mandatory jail <br />provision where the revocation of the individual's license is <br />for non-payment of a fine. <br /> <br /> Accordingly, in accordance with the exception provided for <br />by the General Assembly, the City Attorney has prepared the <br />enclosed ordinance amending the City Code by adding such <br />exception. I recommend adoption of this amendment in order to <br />assure compliance of the City Code with the corresponding <br />provIsion of the State Code." <br /> <br /> On motion of Mrs. Lucas and seconded by Mr. Gray, the <br />following ordinance was adopted on first and final reading, <br />by the following vote: <br /> <br />and <br /> <br />"AN ORDINANCE TO AMEND CHAPTER 23 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTION <br />23-89(b) THEREOF, PERTAINING TO MOTOR VEHICLES." <br /> <br />Ayes: Barnes, Corprew, Gray, <br /> williams, Webb <br />Nays: None <br /> <br />Lucas, Simpson, <br /> <br /> <br />
