<br />AUQust 23. 2011 <br /> <br />(i) The applicant shall be required to install a backflow preventer, if determined <br />necessary by the Department of Public Utilities. <br /> <br />(j) The applicant must obtain and keep current any required operating licenses and <br />shall operate in accordance with federal, state and local regulations. <br /> <br />(k) All taxes and fees in connection with the proposed use shall be paid when due. <br /> <br />(I) The owners and/or operators of the establishment shall not violate any laws of <br />the Commonwealth or ordinances of the City related to peace and good order, not suffer <br />repeated or chronic violations by any of its patrons or customers. If the Chief of Police, <br />in his discretion, determines that there are significant violations of this type to comprise <br />a significant law enforcement problem, he shall so notify the applicant in writing and <br />shall provide a copy of such notice .to the Director of Planning. If, within six months of <br />the date of such letter, the Director of Planning determines that the offenses against <br />peace and good order are continuing, then he may initiate proceedings for the <br />revocation of this permit. Provided, however, that if at any time problems exist of such a <br />severity that the Chief of Police determines that there is a significant risk to public safety <br />or peace and good order of such proportions as to create a risk of blight, revocation <br />proceedings may be initiated by the Director of Planning regardless of the six month <br />requirement. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City CounciL" <br /> <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />11 - 349 - Adoption of an ordinance accepting a grant in the amount of $323,872 <br />from the Virginia Department of Criminal Justice Services and appropriating said <br />amount in the FY 2011-12 Grants Fund for use by the Commonwealth's Attorney's <br />Office for the Victim Witness Program. Vision Principle: Thriving Neighborhoods <br />and a Sense of Community. <br /> <br />Background: <br />. The City of Portsmouth has received a grant from DCJS for continuation funding <br />of the Victim Witness Grant, administered by the Commonwealth's Attorney's Office. <br />. This grant program has grown over the last 20 years to comprise six full-time <br />appointees who served over 1600 victims last year. <br />. This program provides for comprehensive information and direct services to <br />crime victims and witnesses. <br /> <br />Discussion: <br />. The Victim Witness Grant will provide for six full-time appointees dedicated 100% <br />to the Grant's objectives. <br />. It is estimated that this program will serve in excess of 1850 victims annually. <br /> <br />Financial Impact: <br />. There is no cash match required of the City. <br /> <br />Staff Recommends: <br />. Adoption of proposed ordinance. Vision Principle: Thriving Neighborhoods and a <br />Sense of Community. <br /> <br />Next Steps Following Council Action: <br />.
