<br />AUQust 23. 2011 <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the subject property's zoning district; <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in their zoning district(s); <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br />2. That David L. Griffin is hereby granted a use permit pursuant to Section 40.1- <br />2.3B of the Code of the City of Portsmouth, Virginia (2006) to operate an entertainment <br />establishment at 509, 511, and 513 High Street, Portsmouth, Virginia and being more <br />particularly described as: <br /> <br />UP-11-04 <br /> <br />509,511, and 513 High Street <br /> <br />Beginning at a point 79':t from the southwest comer of High and Dinwiddie Streets; <br />thence, in a westerly direction 70':t to a point; thence, in a southerly direction 115':t to a <br />point; thence, in an easterly direction 70':t: to a point; thence, in a northerly direction <br />115':t: to a point of the beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicants and any successor in interest: <br /> <br />(a) The occupant load of the facility shall not exceed 236 persons, including staff and <br />patrons, at any time as required by the Building Official in the combined space of 509, <br />511 and 513 High Street. <br /> <br />(b) The hours of operation shall be no earlier than 8:00 a.m. to no later than 2:00 <br />a.m. <br /> <br />(c) The hours of entertainment shall be no earlier than 11 :00 a.m. to no later than <br />2:00 a.m. <br /> <br />(d) Sufficient interior and exterior security shall be provided by individuals who are <br />certified by the Virginia Department of Criminal Justice Services. <br /> <br />(e) The site layout plan shall generally be in accordance with the floor plan dated <br />November 2,2010. Minor changes may be approved by the Director of Planning. <br /> <br />(f) Rear doors shall be used for emergency exits only and shall not be propped <br />open during hours of operation. <br /> <br />(g) The applicant shall obtain approval from the Downtown Design Committee for <br />any exterior alterations, including signage. <br /> <br />(h) Noise from the establishment shall comply with City Code Section 24-255. <br />
