"The Omibus Budget Reconciliation Act Of 1986 paSsed by the Congress included amendments to the Age Discrimination in Emp'loyment~ ~ct (ADEA) of 1967 which apply to both the Portsmouth Supplemental Retirement SyStem (PSRS) and the Fire and Police Retirement System. This l~gi~sl~tion prohibits'a~ension plan ~rom ceasing to provide credit to an employee's retirement benefit based o,n age~ Presentl~,~the p~ovisions of the Portsmouth retiremen~ systems do not. al.lOw retirement credit for service beyond age 65. This proposed ordinance will amend our~retireme~t code to comply With the new Federal requirements by removing the age 65 limilt for creditable~se~r.~ice. 'The~Portsmouth Retirement Board unanimously ~reco~mended thins change at its JanUary 1988 board meeting. I recommend that the City Council adopt this proposed ordinance." ~On motion of Mr~ Simpson and seconded.by Mr. Lucas, the following ordinance was adopted~ and by the following ~vote: "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH~ VIRGINIA, 1973, BY AMENDING SECTIONS 31-148 (b); ~31'1~5~5 (b); 31-201~ (CREDITABLE SERVICE); 31~262 (b); AND 31-268 (b); PERTAINING TO THE PORTSMOUTH FIRE AND POLICE RETIREMENT SYSTEM AND THE PORTSMOUTH SUPPLEMENTAL RETIREMENT SYSTEM, TO PROVIDE FOR CREDITABLE SERVICE AFTER AGE 65."
