March 22, 1988 2. Eli M. Habib, a lessee, is hereby granted a special exception to the off-street parking requirements in the Downtown D-1 District Mixed Use Subdistrict as provided for in Section 40-121 (b) (iv) for the property located at 612 Court Street (Pythian Castle) by the granting of a waiver of eleven (11) required on, site parking spaces for the operation of~ a bakery and delicatessen, such special exception being approved subject to the following conditions: (a) The special .exception shall be applicable only to that portion of.the building used for the proposed bakery and delicatessen. The waiver is granted on the basis of the proposed use and any change from such use will constitute the expiration of this special exception hereby granted° (b) There shall be pr~ovid~ne (1) o~f~street pa~king spaces on the site." Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Williams, Webb Nays: None 88-99 - The following ordinance approved on first reading at the Regular Meeting of March 8, 1988, was taken up and read. "AN ORDINANCE TO APPROPRIATE $67,000 FROM THE CAPITAL IMPROVEMENT FUND FOR THE PORTSMOUTH SEAWALL LIGHTING AND IMPROVEMENT PROJECT, PHASE II." On motion of Mrs. Lucas and seconded by Mr. Gray, the ordinance was adopted on final reading and by the following vote: Ayes: Barnes, Corprow, Gray, Lucas, Simpson, Williams, Webb Nays: None the 88-100 - The following ordinance approved on first reading Regular meeting of March 8, 1988, was taken up and read. "AN ORDINANCE TO APPROPRIATE $780,000 FROM THE CAPITAL IMPROVEMENT FUND FOR THE CONSTRUCTION OF CLIFFORD STREET EXTENSION FROM CITY PARK AVENUE TO ELMHURST LANE." at On motion of Mr. Gray and seCOnded by Mrsl L~cas,'the ordinance was adOpted on fi~a~l~'re~ding and by tho fOlloWing vote: Ayes: Barnes, COrprew, Gray, LUcas, Simpson, Williams, Webb Nays: None 88-106 - Ordinance to amend the Code of the City of Portsmouth,~Virginia, 19'73, by a-dding to chapter 40 thereof Article ×IV, pertaining to regulating the use and development of Wetlands. Motion of Mr. Gray and seconded by Mrs. Lucas to receive the draft ordinance as information and was adopted by unanimous vote. - REPORTS FROM THE CITY MANAGER - 88-120 - Letter from the City Manager recommending adoption of an ordinance to appropriate $1,180,000 from the Capital Improuemen~ Fund for improvements to PortCentre, and award of contract. ~ ~
