March 22, 1988 <br /> <br /> 2. Eli M. Habib, a lessee, is hereby granted a special <br />exception to the off-street parking requirements in the Downtown <br />D-1 District Mixed Use Subdistrict as provided for in Section <br />40-121 (b) (iv) for the property located at 612 Court Street <br />(Pythian Castle) by the granting of a waiver of eleven (11) <br />required on, site parking spaces for the operation of~ a bakery and <br />delicatessen, such special exception being approved subject to the <br />following conditions: <br /> <br /> (a) The special .exception shall be applicable only to that <br />portion of.the building used for the proposed bakery and <br />delicatessen. The waiver is granted on the basis of the proposed <br />use and any change from such use will constitute the expiration of <br />this special exception hereby granted° <br /> <br /> (b) There shall be pr~ovid~ne (1) o~f~street pa~king <br />spaces on the site." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Williams, Webb <br />Nays: None <br /> <br /> 88-99 - The following ordinance approved on first reading at <br />the Regular Meeting of March 8, 1988, was taken up and read. <br /> <br />"AN ORDINANCE TO APPROPRIATE $67,000 FROM THE CAPITAL <br />IMPROVEMENT FUND FOR THE PORTSMOUTH SEAWALL LIGHTING <br />AND IMPROVEMENT PROJECT, PHASE II." <br /> <br /> On motion of Mrs. Lucas and seconded by Mr. Gray, the <br />ordinance was adopted on final reading and by the following vote: <br /> <br />Ayes: Barnes, Corprow, Gray, Lucas, Simpson, Williams, Webb <br />Nays: None <br /> <br />the <br /> <br />88-100 - The following ordinance approved on first reading <br />Regular meeting of March 8, 1988, was taken up and read. <br /> <br /> "AN ORDINANCE TO APPROPRIATE $780,000 FROM THE CAPITAL <br /> IMPROVEMENT FUND FOR THE CONSTRUCTION OF CLIFFORD STREET <br /> EXTENSION FROM CITY PARK AVENUE TO ELMHURST LANE." <br /> <br />at <br /> <br /> On motion of Mr. Gray and seCOnded by Mrsl L~cas,'the <br />ordinance was adOpted on fi~a~l~'re~ding and by tho fOlloWing vote: <br /> <br /> Ayes: Barnes, COrprew, Gray, LUcas, Simpson, Williams, Webb <br /> Nays: None <br /> <br /> 88-106 - Ordinance to amend the Code of the City of <br />Portsmouth,~Virginia, 19'73, by a-dding to chapter 40 thereof <br />Article ×IV, pertaining to regulating the use and development of <br />Wetlands. <br /> <br /> Motion of Mr. Gray and seconded by Mrs. Lucas to receive the <br />draft ordinance as information and was adopted by unanimous vote. <br /> <br /> - REPORTS FROM THE CITY MANAGER - <br /> <br /> 88-120 - Letter from the City Manager recommending adoption <br />of an ordinance to appropriate $1,180,000 from the Capital <br />Improuemen~ Fund for improvements to PortCentre, and award of <br />contract. ~ ~ <br /> <br /> <br />
