<br />February 8. 2011 <br /> <br />11 - 70 - Adoption of a resolution authorizing the City Manager to enter into an <br />Operating Agreement and to execute such other documents as may be necessary to <br />formalize the responsibilities of the City of Portsmouth, the Virginia Port Authority, and <br />other localities with respect to maritime incident responses. Vision Principle: Thriving <br />Neighborhoods and a Sense of Community. <br /> <br />Background: <br />. The City of Portsmouth provides trained personnel that are members of the <br />Maritime Incident Response Team (MIRT) for marine emergency operations. <br />. The MIRT is made up of personnel from various jurisdictions and coordinated <br />through the Virginia Port Authority. <br /> <br />Discussion: <br />. The Virginia Port Authority Maritime Incident Response Team Operating <br />Agreement formalizes the responsibilities of each participating jurisdiction and the <br />Virginia Port Authority. <br />. The Virginia Port Authority Maritime Incident Response Team Operating <br />Agreement has been reviewed by the City Attorney's office. <br /> <br />Financial impact: <br />. No City funds are involved with execution of this Operating agreement and <br />related agreements. <br /> <br />Recommended Action: <br />. Adoption of the resolution. Vision Principle: Thriving Neighborhoods and a <br />Sense of Community. <br /> <br />Next Steps Following Council Action: <br />. City Manager signs agreement. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN <br />OPERATING AGREEMENT AND TO EXECUTE SUCH OTHER DOCUMENTS AS <br />MAY BE NECESSARY TO FORMALIZE THE RESPONSIBILITIES OF THE CITY OF <br />PORTSMOUTH, THE VIRGINIA PORT AUTHORITY, AND OTHER LOCALITIES <br />WITH RESPECT TO MARITIME INCIDENT RESPONSES. <br /> <br />WHEREAS, the City of Portsmouth and other localities supply personnel to the <br />Maritime Incident Response Team (MIRT) in order to address local maritime <br />emergencies; and <br /> <br />WHEREAS, the MIRT is coordinated through the Virginia Port Authority; and <br /> <br />WHEREAS, the Virginia Port Authority and the member localities desire to enter <br />into an Operating Agreement that formalizes the responsibilities of each participating <br />jurisdiction and the Virginia Port Authority. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it hereby authorizes the City Manager to enter into an operating agreement <br />on its behalf with the member localities of the Maritime Incident Response Team and <br />the Virginia Port Authority to formalize the Team's responsibilities and those of the <br />Virginia Port Authority with respect to the operations of the Maritime Incident Response <br />Team." <br /> <br />Ayes: Cherry, Edmonds, Moody, Randall, Whitehurst, Wright <br />Nays: None <br />
