201 <br /> <br />September 13, _1988 <br /> <br /> NOW, THEREFORE, BE.IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the special exception to be granted: <br /> <br />persons <br /> <br />(a.) Will not adversely affect the health and ~safety <br />residing or working in the neighborhood; <br /> <br />of <br /> <br /> (b) Will not be detrimental to the public, use or <br />in3urious to the property or improvements in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes and_objectives <br />of the Port Norfolk Historic Limited Business Subdistrict and the <br />Zoning Chapter of the Code of the City of Portsmouth, Virginia. <br /> <br /> 2. William and Bonnie Skillman are hereby granted a special <br />exception to the off-street parking requirements in the Port <br />Norfolk Historic Limited Business Subdistrict as provided for in <br />~40-102 (I)-(2) for the property at 401 Mount Vernon Avenue and <br />2721 and 2723, Detroit Street by the granting of a waiver for nine <br />(9) required on-site parking spaces, such special exception being <br />approved subject to the following condition: <br /> <br /> (a) The use:of the property shall De limited to a <br />bakery/delicatessen and ice cream parlor with a maximum of six <br />(6) tables seating twenty-four (24) persons and office on the <br />first~floor ~nd.a residence on.the second-floor. ~The special <br />exception is~granted on the basis of the proposed use and any <br />change from s:uch use will.constitute the expiration of~the special <br />exception hereby granted. <br /> <br /> 3. This resolution shall take effect i~mediately upon <br />adoption." <br /> <br />88-328 - <br /> <br />"AN ORDINANCE TO APPROPRIATE $37,530.00 FROM THE CAPITAL <br />IMPROVEMENT FUND FOR MISCELLANEOUS IMPROVEMENTS-TO <br />CRAWFORD STREET, GREENBROOK DRIVE, SMITH AVENUE AND <br />KANSASAVENUE." . <br /> <br />88-329 <br /> <br />"AN ORDINANCE TO APPROPRIATE $30,000.00 FROM THE CAPITAL <br />IMPROVEMENT FUND FOR CAVALIER MANOR RECREATION COMPLEX <br />IMPROVEMENT PROJECT, PHASE II." <br /> <br />Ayes: Barnes, Corprew, Gray, Hawks, Lucas, Simpson, Webb <br />Nays:-None. <br /> <br />- REPORTS FROM THE CITY MANAGER - <br /> <br /> 88-343 - Letter from the City Manager recommending adoption <br />of an ordinance to revise the City Code dealing with sewer sc <br />deleting the Industrial Waste Program (which~HRSD-will now <br />administer under the plant transfer) and strengthening~Sections <br />38-77 (f) and 38-83 which define the City's system and set~ fees <br />where prohibited discharges damage the City's system. <br /> <br /> "The attached ordinance revokes the City's Industrial <br />Wastewater Monitoring and Permit Program as HRSD will administer <br />this with the Pinners Point Plant transfer. It also strengthens <br />the penalty due where prohibited discharges cause damage to flhe <br />City's sewer system. <br /> <br /> <br />
