<br />October 26. 2010 <br /> <br />1. Judi Luffman, 5800 High Street, spoke in support of this item. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Moody, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A <br />MEMORANDUM OF UNDERSTANDING WITH THE SOUTHEAST VIRGINIA <br />COMMUNITY FOUNDATION ACCEPTING THE DONATION OF POKEY SMOKEY II <br />AND PROVIDING FOR CITY OPERATION AND MAINTENANCE OF THE TRAIN. <br /> <br />WHEREAS, for many years the Department of Parks, Recreation and Leisure <br />Services (DPRLS) operated the Pokey Smokey, a miniature train ride at Portsmouth <br />City Park; and <br /> <br />WHEREAS, in 2006, the City sold the coal-fired steam engine and coaches, and <br />the funds from the sale were deposited with the Portsmouth Community Foundation <br />(now the Southeast Virginia Community Foundation (SVCF)) to be used toward <br />purchase of a new train ("Pokey Smokey II"); and <br /> <br />WHEREAS, SCVF has now raised sufficient funds and is prepared to purchase a <br />new engine and coach for donation to the City; and <br /> <br />WHEREAS, a Memorandum of Understanding (MOU) is now advisable <br />specifying the obligations of SVCF and the City for the donation, operation and <br />maintenance of Pokey Smokey II. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it hereby authorizes the City Manager to accept the donation of the Pokey <br />Smokey II on behalf of the City and furthermore authorizes him to enter into the draft <br />Memorandum of Understanding with the Southeast Virginia Community Foundation for <br />the maintenance and operation of the train at Portsmouth City Park and under such <br />additional terms as he deems in the best interests of the City." <br /> <br />Ayes: Cherry, Heretick, Moody, Psi mas, Randall, Whitehurst, Griffin <br />Nays: None <br /> <br />10 - 496 - Adoption of a resolution authorizing the Economic Development Authority to <br />retain a payment of $223,960 received by the Authority from Dominion Virginia Power <br />for an easement over property owned by the City of Portsmouth in the City of Suffolk. <br />Vision Principle: A Robust and Prospering Economy. <br /> <br />Background: <br />. The Economic Development Authority (EDA) is in receipt of $223,960 paid by <br />Dominion Virginia Power (Dominion) for an easement across City owned property in <br />Suffolk. The payment was made to the EDA as a result of a cooperation agreement <br />between the City and EDA under which the City conveyed its interests in the property to <br />the EDA for the purpose of having the EDA convey them to Dominion in accordance <br />with Virginia law concerning property transfers by public entities. <br />. On transactions unrelated to the easement payment, the EDA purchased two <br />homes, 3100 Dartmouth and 3100 Brighton, along Frederick Boulevard for the purpose <br />of creating a landscape buffer in keeping with City plans for that area. The homes, and <br />associated expenses to date, cost the EDA $350,637.07. <br />. The EDA has previously requested the City reimburse it $350,637.07 for these <br />properties and assume ownership and maintenance of them. The City had not, and has <br />not, budgeted for said expenses. <br />. At its regularly scheduled September 21, 2010 meeting, the EDA adopted a <br />motion requesting the City allow it to retain the funds received from Dominion as final <br />reimbursement for the properties and in lieu of any additional or future payment for <br />these two homes. <br />
