October 26. 2010

10 - 493 - Adoption of an ordinance to appropriate $4,019,217 in the FY 2010-2011
Portsmouth Public Schools Budget in monies received from the U.S. Department of
Education Jobs Fund. Vision Principle: Lifelong Learning Community.

Background:
. The Education Jobs Fund, Public Law 111-226, approved on August 10, 2010
provides $10 billion in assistance to States to save or create education jobs.
. Based on Virginia's application, Portsmouth Public Schools was apportioned
$4,019,217 from the Education Jobs Fund.
. These funds are available for obligation between August 10, 2010 and
September 30, 2012.
. A School Division may use these funds only for compensation and benefits and
other expenses, such as support services, necessary to retain existing employees, to
recall or rehire former employees, and to hire new employees, in order to provide early
childhood, elementary, or secondary educational and related services.

Discussion:
. In order to expend the Education Jobs Funds, an appropriation by City Council is
required.

Financial Impact:
. These funds will be used to reduce the impact of the reduction of over $14 million
in Virginia and American Recovery and Reinvestment Act (ARRA) funds from the
School Board Budget between FY2010 and FY2011. An additional $1.5 million
reduction of Virginia funds from the FY2012 School Board budget is included in the
State's biennial budget.
. There is no required match for these funds.

Staff Recommends:
. Adoption of ordinance. Vision Principle: Lifelong Learning Community.

Motion by Mr. Whitehurst, and seconded by Ms. Randall, to adopt the following
ordinance, and was adopted by the following vote:

"ORDINANCE TO APPROPRIATE IN THE FY 2010-2011 PORTSMOUTH PUBLIC
SCHOOLS BUDGET $4,019,217 IN MONIES RECEIVED FROM THE U.S.
DEPARTMENT OF EDUCATION JOBS FUND."

Ayes: Cherry, Heretick, Moody, Psi mas, Randall, Whitehurst, Griffin
Nays: None

10 - 494 - Adoption of a resolution to approve expansion of the provision of Juvenile
Competency Restoration Services by the Portsmouth Department of Behavioral
Healthcare Services (DBHS). Vision Principle: Thriving Neighborhoods and a Sense of
Community.

Background:
. DBHS as well as other Health Planning Region V (HPR-V) Community Services
Boards have been performing juvenile competency restoration services for the past five
years through contracts with the Virginia Department of Behavioral Health and
Developmental Services (DBHDS). Due to budget cuts and changes in services
delivery by other HPR-V CSBs, DBHS has emerged as primary provider of Juvenile
Competency Services for the region. DBHS has augmented its revenue as a result of
providing these services for juveniles referred for services.

Discussion:
. Due to the timely and efficacious performance of Juvenile Competency
restoration services by DBHS through the past five years and decrease of other
providers in the region, Ms. Jeanette DuVal, L.C.S.W., Director of the Juvenile
Competency Restoration Services requested DBHS become the primary provider of
juvenile competency restoration services for HPR-V.
