<br />September 28. 2010 <br /> <br />(c) Three (3) parking spaces shall be designated for the drop off and pick up of <br />children. This requirement shall be fulfilled prior to the issuance of the certificate of <br />occupancy. <br /> <br />(d) Days and hours of operation shall be Monday through Friday between 7:00 a.m. <br />and 6:00 p.m. Outdoor play shall be no later than 6:00 p.m. This condition is not <br />intended to limit or prohibit childcare services provided coincident with a church service <br />or function where such accessory use is generally permitted. <br /> <br />(e) The applicant shall maintain the existing 4-foot grey chain link fence around the <br />outdoor play area. Any new fencing shall be a 4-foot black vinyl coated chain link fence. <br />The fencing shall not contain opaque slats. <br /> <br />(f) The existing tree line along the northeastern boundary of the property shall be <br />maintained. An opaque vegetative screen shall be established along the southern <br />boundary of the parking area facing Portsmouth Boulevard. The screen shall consist of <br />shrubs that are a minimum of 36" in height alternating with 2 %" caliper canopy trees <br />that are a maximum of 8 feet in height. An alternative plan may be submitted for review <br />and approval by the Planning Director. The approved landscaped buffer shall be <br />installed prior to the issuance of a certificate of occupancy. <br /> <br />(g) Proposed signage shall comply with Section 40.1-5.11 (H)(4) - Sign, Institutional <br />Freestanding and shall be reviewed and approved by the Zoning Administrator. <br /> <br />(h) The facility shall be operated in compliance with applicable codes, ordinances <br />and regulations of federal, state and local government and all required licenses and <br />permits shall be obtained and remain in effect during the operation of the facility. <br /> <br />(i) All taxes or fees associated with the operation shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Cherry, Heretick, Moody, Psi mas, Randall, Whitehurst, Griffin <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />10 - 446 - Adoption of an ordinance accepting a grant in the amount of $47,289 from the <br />Virginia Department of Motor Vehicles and appropriating said amount in the FY 2010- <br />2011 Grants Fund to be used by the Police Department for Comprehensive Speed, DUI, <br />and Passenger and CMV Occupant Restraint Enforcement. Vision Principles: Thriving <br />Neighborhoods and a Sense of Community and Pride of Past, Promise of Future. <br /> <br />Background: <br />. The Portsmouth Police Department has received grant funding in the amount of <br />$47,289.00 from the Department of Motor Vehicle (DMV). The funds will be used for <br />Comprehensive Driving under the Influence (DUI), Speed, Passenger Vehicle and <br />Commercial Motor Vehicle (CMV) Occupant Restrain Enforcement. <br /> <br />Discussion: <br />. The Portsmouth Police Department desires to increase the seatbelt usage by <br />CMV's significantly and to also reduce traffic crashes with the potential of injuries and <br />seat through educational efforts, enforcement and building of partnerships. <br />. The funds received will enable Portsmouth Police Department to provide <br />Overtime payment and equipment to be utilized by law enforcement in the areas of <br />Comprehensive Driving under the Influence (DUI), Speed, Passenger Vehicle and <br />Commercial Motor Vehicle (CMV) Occupant Restrain Enforcement. <br />
