<br />September 28. 2010 <br /> <br />Background: <br />. The City Council adopted Ordinance No. 2010-74 on August 24, 2010 <br />appropriating $4,000,000 in the FY 20101-2011 City Garage Fund from its Fund <br />Balance to provide funds for the purchase of vehicles and declaring the intent of the City <br />to reimburse itself from the proceeds of the obligations of the City. This is a companion <br />resolution to facilitate the purchase of certain apparatus for the fire department. <br />. Portsmouth City Code Section 12-177 allows for the purchasing of commodities <br />through the use of cooperative procurement agreements by other local governing <br />bodies. <br />. By utilizing a cooperative procurement agreement for the purchase of fire <br />apparatus, the City indirectly saves money by eliminating steps that will not add value. <br />. The Houston-Galveston Area Council (HGAC) is incorporated under Texas <br />Statute to conduct cooperative procurements on behalf of other local governing bodies <br />throughout the Continental United States. HGAC has contracted and procured fire <br />apparatus that meet or exceed the standards and needs for the Portsmouth Fire <br />Department. <br />. In order to purchase from HGAC contracts, the City must execute an agreement <br />with the Houston-Galveston Area Council. The language of the agreement requires City <br />Council authorization prior to any procurement action. <br /> <br />Discussion: <br />. Adoption of this resolution will authorize the City to purchase goods and services <br />from the Houston-Galveston Area Council contracts, resulting in a timely and efficient <br />procurement process. It also authorizes the City Manger to execute all documentation <br />necessary to facilitate this transaction. <br /> <br />Financial Impact: <br />. None. <br /> <br />Recommended Action: <br />. Execute an agreement with the Houston-Galveston Area Council. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Heretick, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION TO ALLOW THE CITY OF PORTSMOUTH TO PURCHASE <br />COMMODITIES FROM A COOPERATIVE PROCUREMENT AGREEMENT <br />ESTABLISHED BY THE HOUSTON-GALVESTON AREA COUNCIL AND TO <br />AUTHORIZE THE CITY MANAGER TO EXECUTE ALL DOCUMENTS RELATED TO <br />THIS TRANSACTION. <br /> <br />WHEREAS, Portsmouth City Code Section 12-177 allows for the purchasing of <br />commodities through the use of cooperative procurement agreements by other local <br />governing bodies; and <br /> <br />WHEREAS, the it has been determined that it will be to the City's advantage to <br />purchase new fire apparatus through the Houston-Galveston Area Council (HGAC), an <br />entity incorporated under the laws of the State of Texas to conduct cooperative <br />procurements on behalf of other local governing bodies throughout the continental <br />United States; and <br /> <br />WHEREAS, HGAC has contracted and procured fire apparatus that meet or <br />exceed the standards and needs for the Portsmouth Fire Department; and <br />
