<br />September 14. 2010 <br /> <br />Discussion: <br />. This agreement incorporates minor revisions to the previously existing Mutual Aid <br />Agreement signed by both parties and adopted by Council resolution in 1989. <br />Fundamentally the agreements remain almost identical. <br />. The U. S. Coast Guard through this new agreement made available the <br />authorized use of Morale, Welfare, and Recreation (MWR) facilities not previously <br />covered in the 1989 agreement. <br />. The agreement authorizes voluntary inter-jurisdictional assistance and <br />cooperation between Portsmouth Police Department and the U. S. Coast Guard. <br /> <br />Financial Impact: <br />. No material financial impact. <br /> <br />Recommended Action: <br />. Adoption of the resolution IS recommended. Vision Principle: Bold New <br />Directions. <br /> <br />Next Steps Following Council Action: <br />. Manager to sign agreement. <br />. Agreement to be implemented by the Portsmouth Police Department. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Moody, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A MUTUAL AID <br />AGREEMENT AND FUTURE AGREEMENTS BETWEEN THE CITY OF <br />PORTSMOUTH AND THE U.S. COAST GUARD." <br /> <br />WHEREAS, Virginia law authorizes local governments to enter into mutual aid <br />agreements and to provide police cooperation and assistance; and <br /> <br />WHEREAS, federal law authorizes the U.S. Coast Guard to enter into mutual aid <br />agreements for providing cooperation and assistance, and <br /> <br />WHEREAS, the U.S. Coast Guard and the City of Portsmouth propose to enter <br />into a mutual aid agreement for law enforcement response purposes within the U.S. <br />Coast Guard Base Support Unit Portsmouth and the City of Portsmouth; <br /> <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that the City Manager is hereby authorized to execute a Mutual Aid Agreement, <br />in a form substantially similar to Exhibit 1 attached hereto, with the U.S. Coast Guard for <br />inter-jurisdictional assistance, cooperation and enforcement action. <br /> <br />BE IT FURTHER RESOLVED that the City Manager is further authorized to <br />enter into similar agreements with the U.S. Coast Guard in the future without the <br />necessity of further City Council approval if he deems said agreements to be in the best <br />interest of the City of Portsmouth. <br /> <br />Ayes: Cherry, Moody, Psi mas, Whitehurst, Griffin <br />Nays: None <br /> <br />10 - 421 - Adoption of a resolution authorizing the City Manager to execute a Right of <br />Way Agreement with Virginia Electric and Power Company for a power line cable <br />across the property of the City to serve the James Hurst Elementary School. Vision <br />Principle: Thriving Neighborhoods and a Sense of Community. <br /> <br />Background: <br />. Virginia Electric and Power Company has requested a right of way across <br />property of the City of Portsmouth for the purpose of installing a power line cable to <br />serve the addition to the James Hurst Elementary School. <br />
