January 10, 1989 Other Items Under Unfinished Business 88-477 Use Permit application: (a) UP 88-13 Motion of Mrs. Lucas and seconded Simpson the following resolution was adopted on final by the following vote: by Mr. reading, and "A RESOLUTION GRANTING A USE PERMIT TO INTERNATIONAL CENTER FOR CREATIVE THINKING AND LEARNING, INC., T/A RIVKA LEWIS DAYCARE CENTER TO OPERATE A CHILD-CARE CENTER AT 716 COUNTY STREET AND TO PROVIDE OUTDOOR RECREATION FOR THE CHILD-CARE CENTER AT THE CORNER OF GREEN AND COUNTY STREETS. WHERE~S~ International Center For Creative Thinking And Learning, Inc.~ (a Virginia CorporatiOn) T/A Rivka Lewis Daycare Center, has made application pursuant to ~40-121 (a) (i) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit to operate a childTcare center at 716 County Street and to provide outdoor recreation for the child-care center at the corner of County and Green Streets; and WHEREAS, th~ applicant and all things required to be done application; and the Planning Director have done in connection with said WHEREAS, the Planning Commission conditional granting of a-use permit child-care center. has recommended the ~or the operation of NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health persons residing or working in the neighborhood of use; and safety of the proposed injurious to and Will not be detrimental to the public use or the property and improvements of the neighborhood; (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. International Center For Creative Thinking And Learning, Inc., T/A Rivka Lewis Daycare Center, is hereby granted a use permit pursuant to ~40-121 (a) (i) of the Code of the City of Portsmouth, Virginia, 1973, to operate a child-care center at 716 County Street and to provide outdoor recreation for the child-care center at the corner of Green and County Streets such outdoor recreation area being more particularly described as follows:
