<br />AUQust 24. 2010 <br /> <br />Motion by Ms. Psimas, and seconded by Ms. Randall, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO APPROPRIATE $2,254,000 IN THE FY 2010-2011 PUBLIC <br />UTILITIES FUND OPERATING BUDGET FROM UNRESTRICTED RETAINED <br />EARNINGS TO PURCHASE EMERGENCY DROUGHT RAW WATER FROM THE <br />CITY OF NORFOLK." <br /> <br />Ayes: Cherry, Heretick, Moody, Psi mas, Randall, Whitehurst, Griffin <br />Nays: None <br /> <br />10 - 397 - Adoption of an ordinance designating Lexington Drive and Dale Drive as <br />highways for purposes of law enforcement. Vision Principle: Thriving Neighborhoods <br />and a Sense of Community. <br /> <br />Background: <br />. Portions of Lexington Drive and Dale Drive were closed and vacated as public <br />streets pursuant to ordinances 2009-53 and 2009-54. The purpose of these street <br />closures was to allow Portsmouth Redevelopment and Housing Authority (PRHA) to <br />better control unauthorized persons being present in Lincoln Park and Dale Homes. <br /> <br />Discussion: <br />. As a result of the aforementioned streets closure, they have become private <br />streets. This has caused some concern about police enforcement of traffic laws within <br />these corridors. Section 46.2-1307 provides that the governing body of a City may <br />designate private roads as highways for law enforcement purposes within any <br />residential development containing 100 or more residential dwelling units. <br /> <br />Financial Impact: <br />. None. <br /> <br />Staff Recommends: <br />. Adoption of an ordinance authorizing the designation of the closed and vacation <br />portions of Lexington Drive and Dale Drive as highways for purposes of law <br />enforcement in compliance with Section 46.2-1307. Vision Principle: Thriving <br />Neighborhoods and a Sense of Community. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Heretick, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE DESIGNATING LEXINGTON DRIVE, DALE DRIVE, MERRIMAC <br />DRIVE AND BUCHANAN AVENUE AS HIGHWAYS FOR PURPOSES OF LAW <br />ENFORCEMENT." <br /> <br />Ayes: Cherry, Heretick, Moody, Psi mas, Randall, Whitehurst, Griffin <br />Nays: None <br /> <br />10 - 398 - Adoption of an ordinance to appropriate $1,683.50 in the FY 2010-2011 <br />Grants Fund for the training of police auto theft investigators. Vision Principle: Thriving <br />Neighborhoods and a Sense of Community. <br /> <br />Background: <br />. The Portsmouth Police Department has received grant funding of $1,683.50 from <br />the State Police. <br /> <br />Discussion: <br />. These funds will be used to send detective to attend the 2010 International <br />Association of Auto Theft Investigators (I.A.A.T.I.) training seminar. <br /> <br />Financial Impact: <br />. There is no local cash match required. <br />
