January 24, 1989 331 described~on plains filed w~ithithe~appropriate officials of the Cit~ of Portsmouth, virginia, such plans and documentations in support thereof being made a part hereof is hereby granted approval subject to the following terms and conditions: (t) ~Needed drainage easements must be obtained from the owners~of the apartment complex to the north. (2) A full hydrological study for the site must be submitte~ to and approved by the Engineering Department~ prior to final site Plan~approval. (3) A plan showing the type and location of playground equipment must be submitted and approved by the Planning Department prior to final site plan approval,~ AdoPted by,the CounCil of the City of Portsmouth, Virginia, at a meeting held January 24, 1989." (h) "A RESOLUTION GRANTING A USE PERMIT TO THE NEW MOUNT ZION CHURCH OF GOD IN CHRIST TO OPERATE A CHURCH AND PLACE OF WORSHIP AT 1224 CAVALIER BOULEVARD. WHEREAS, ThomaS Goodwyn, Trustee, of the New Mount Zion Church Of God In Christ, has made application pursuant to ~40-70 (b) of the Code of the City of Portsmouth, Virginia, 1973, for granting~Oif.a use Permit aS hereinafter-described; and W~HEREAS, the applicant and the Planning. Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the grantin( of a use permit with conditions for the operation of a church and- place of worship. · NOW,~THEREFORE~ BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1~ The use for~which the use permit hereinafter-described is Sought: (a) Will not adversely affect the health and safety of persons residing or working in, the neighborhood of the proposed use; (b) Will not be detrimentaI-to the public use or injurious to the property or improvements in the neighborhood; an( (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. The New Mount Zion Church of God In Christ is hereby granted a use permit pursuant to ~40~70 (b)of the Code of the City of Portsmouth, Virginia, to operate a Church and place of worship on property deSignated.ias 1224 Cavalier Boulevard which consists of approximately ~570 acres:of land and is described as Tax Map 548, Parcel 36 (UP-88-15). 3. This use permit islapproved subject ~to the following conditions: (a) Occupancy of the ChurCh will be limited to a maximum of one hundred (100) persons at any one time.
