February 14, 198.9. <br /> <br /> WHEREAS, the City of Portsmouth is el.igible to submit <br />grant applications for funding pursuant to regulations governing <br />the administration and use of such funds; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that th~ Cit~ M~nag~r 'b~ and he hereby <br />is, authorized to submit an application for funding to The <br />Busine'ss Consor%ium for Arts Supp~ort ~to support proUr~mming and <br />e×hibiti~n's~'scheduled for FY-1989-90." <br /> <br /> Ayes: Barnes, Corprew, 'Gray, Hawks, Lucas, Sim~soh~'Webb <br /> Nays: None <br /> <br /> 89-59 Letter from the City Manag.er recommending adoption <br />of a resolution authorizing the City Manager to sign a deed of <br />release for development 'restrictions b'n property con~eye'd to the <br />Industrial Development' Authority' of t~e 'Cit~' of Portsmoulth <br />located on Lee ~venue and Detroit Street. <br /> <br /> "As pr~giously discussed wi%h City Council, the Virginia <br />Port Authority (VPA) is acquiring property within the area <br />designated for their use by the City-VPA Memorandum of Intent. <br />The property being acquired is to be utilized in the design of a <br />new entryway to Portsmouth Marine Terminal in conjunction' with <br />the anticipated construction of a connector between the Martin <br />Luther King Freeway and the West Norfelk Bridge. <br /> <br /> One of the parcels of land (see enclosed) being acquired <br />was previously conveyed by the City of Portsmouth to the <br />Industrial Development Authority for sale and private use by <br />Robert W. Foley. Deed restrictions governing the private use of <br />the property by Mr. Foley were included in the Deed from t~e <br />City to the Industrial Development'Authority. Since the <br />property is now to be utilized by the VPA as described above, <br />the restrictions which were intended to govern private use and <br />development of the property are no longer pertinent nor <br />required. <br /> <br /> The ~City Attorney has prepared the attached Resolution <br />authorizing release of the restrictions, and I recommend-City <br />Council's approval." <br /> <br /> Motion of Mr. Gray <br />following resolution was <br />by the following vote: <br /> <br />and seconded by Mr. Hawks, 'the <br />adopted on first and final reading and <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN A DEED <br />OF RELEASE FOR DEVELOPMENT RESTRICTIONS ON PROPERTY CONVEYED TO <br />THE INDUSTRIAL DEVELOPMENT AUTHORITY OF THE CITY OF PORTSMOUTH <br />LOCATED ON LEE AVENUE AND DETROIT STREETS; <br /> <br /> WHEREAS, pursuant to resolution adopted by the Council of <br />the City of Portsmouth on April 10, 1984, certain property <br />described as lots 56, 57, 58, 96, 97, and 98 on the plat of <br />Pinners Point Land Company was conveyed to the Industrial <br />Development Authority"bf the C'ity ~ Portsmouth for the purpose <br />of marketing to a private developer; and <br /> <br /> ]~HEREAS, said deed contained certain restrictions <br />pertaining to the use and improvement of the subject property; <br />and <br /> <br /> WHEREAS, said property has now been conveyed to the <br />Virginia Port Authority for development of the Portsmouth Marine <br />Terminal within the area designated for Virginia Port Authority <br />use pursuant to the Port Unification Agreement; and <br /> <br /> <br />
