426 <br /> <br />A~pril 25, 1989 <br /> <br /> The State Bureau of Maternal and Child Health is awarding <br />the Portsmouth Health Department the sum of $90,522 in federal <br />funds to renew the program for a sixth year. No local match is <br />requiredf and the program is renewable on an annual basis. I <br />recommend approval to continue the program a sixth year and the <br />appropriation of"$90,522 for this program." <br /> <br /> M6tion Of Mr. Gray and seconded by Mrs. Lucas, the <br />following ordina~c~ was approved on first reading, and by <br />unanimous vote: <br /> <br /> "AN ORDINANCE TO APPROPRIATE $90,522. FROM THE GRANTS FUND <br />FOR THE PERINATAL HEALTH CARE PROGRAM." <br /> <br /> 89-162 Letter from the City Manager recommending adoption <br />of an ordinance to amend Section 4-12 of the Code of the City of <br />Portsmouth, Virginia, 1973, as amended, pertaining to dogs and <br />cats. <br /> <br /> "~t the last City Council meeting several ordinances <br />regarding animal control were considered including a public <br />nuisance ordinance, a wild animal ordinance, setback <br />requirements for accessory structures and limiting the number of <br />animals per residential dwelling unit. At the same meeting, you <br />requested that staff explore the possibility of a "grandfather <br />clause" for the ordinance limiting the number of dogs and cats <br />to four per dwe~lling unit. This matter has been carefully <br />reviewed by staff, and an ordinance has been prepared by the <br />City Attorney which conforms to your request. <br /> <br /> The ordinance as prepared requires the limitation of dogs <br />and/or cats to four. However, they may register their dogs <br />and/or cats if they have more than four with of the Bureau of <br />Animal Control within 30 days of the date of the ordinanCe. <br />Finally, it should be noted that this ordinance does not <br />supersede the zoning prohibition Of kennels in residential <br />areas. <br /> <br /> Even though the o~dinance conforms to your requests, <br />administratively officials feels that it will be virtually <br />complicated and i~effective. Therefore, if Council would allow <br />me to suggest a possible modification: limit the number of dogs <br />and/or cats to four; however, the effective date of the <br />ordinance would be one year from today. <br /> <br /> I encourage your careful review of the attached ordinance <br />and consideration of the alternative suggested." <br /> <br /> The following citizens spoke in opposition to the <br />ordinance due to the restrictions on the number of animals <br />allowed: <br /> <br />Terry Goldfarb:, 1906 Halifax Avenue. <br />Lydia Armistead, 408 Elmhurst Lane. <br />Jean Campbell, 408 Elmhurst Lane. <br />Cynthia Bocian, 118 Florida Avenue. <br /> <br /> Motion of Mr. ~awks and seconded by Mr. Gray, <br />adoption of the ordinance and denial was adbpted by <br />following vote: <br /> <br />to deny the <br />the <br /> <br />Ayes: Gray, Hawks, Lucas, Simpson, Webb <br />Nays: Barnes, Corprew <br /> <br /> <br />
