Au.qust 22, 2000 <br /> <br /> 2. That Ronald and Verle Weiss are hereby granted a use permit pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation <br />of a bed and breakfast facility on property located at 201 North Street, and being more <br />particularly described as: <br /> <br />UP-00-13 <br /> <br />Beginning at the southwest corner of North Street and Crawford Parkway; <br />thence, in a westerly direction 33'+/- to a point; thence, in a southerly <br />direction 88'+/- to a point; thence, in an easterly direction 33'+/-to a point; <br />thence, in a northerly direction 88'+/- to the point of beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br /> (a) The facility shall be operated in accordance with the provisions governing <br />the operation of bed and breakfast facilities contained in Section 40-52.7 of the City <br />Code. <br /> <br /> (b) The facility shall further be operated in accordance with Exhibit A, <br />attached hereto and made a part hereof. Exhibit A shall consist of Attachment A to the <br />Application for a Use Permit filed by the applicants. <br /> <br />(c) The facility shall have no more than four guest bedrooms. <br /> <br /> (d) All exterior additions and alterations, including signage, must be reviewed <br />and approved by the Commission of Architectural Review prior to construction or <br />installation. <br /> <br /> (e) Prior to requesting a certificate of occupancy, the applicants must obtain <br />designation by the City Traffic Engineer of six off-street parking spaces in the North <br />Street public parking lot adjacent to 201 North Street for the facility's use. <br /> <br /> (f) All taxes in connection with the proposed facility and the subject property <br />shall be paid when due. <br /> <br /> (g) The facility shall comply with all other applicable federal, state, and local <br />codes, ordinances and regulations and shall obtain and maintain in effect all necessary <br />licenses and permits. <br /> <br /> (h) In accordance with Section 40-52.7 (13) of the City Code, the use permit <br />shall not be transferable. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Moody, to adopt the following <br />ordinance, approved at the August 8, 2000 meeting, and was adopted by the following <br />vote: <br /> <br />00-191 (c): <br /> <br />"AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY ENACTING A NEW SECTION 40-41.24 <br />THERETO AND AMENDING TABLES 40-43.1-2, 40-44-3, 40-44-4, AND 40-61.1-1 <br />THEREOF PERTAINING TO THE CREATION OF A BUSINESS PARK (BP) ZONING <br />DISTRICT CLASSIFICATION." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br /> <br />
