<br />April 27. 2010 <br /> <br />- City Manager's Report - <br /> <br />10 - 202 - Adoption of an ordinance authorizing the City Manager to convey two <br />easements to the Economic Development Authority of the City of Portsmouth for the <br />transmission and distribution of electricity over and across Suffolk lakes property. <br />Vision Principles: Bold New Directions and a Robust and Prospering Economy. <br /> <br />Background: <br />. The City has some 3,000 acres of lands in the City of Suffolk, Virginia which <br />serve as the City's reservoirs and water works, which includes several hundred acres <br />that serve as watershed for the lakes. <br />. Virginia Electric and Power Company (VEPCO) has been approved to construct <br />a new transmission and distribution line which will terminate in Suffolk, and which will <br />need to cross a portion of Portsmouth's watershed property. VEPCO has an existing <br />transmission line crossing watershed property. <br />. VEPCO has asked that the City of Portsmouth convey it two easements across <br />its watershed property, adjacent to its existing transmission lines. <br /> <br />Discussion: <br />. The City Charter provides that in order to grant an easement, or any right to use <br />City property, the proposed conveyance of such easement or right must be advertised <br />for bid. It also places limitations on the length of time such an easement may be <br />granted, which is not practical for a transmission line easement. <br />. The City may convey the easement to the EDA without such restrictions. The <br />EDA , in turn, will convey the easement to VEPCO. The grant of such an easement <br />with appropriate restrictions as to use should not interfere with the function of the <br />watershed. <br /> <br />Financial impact: <br />. VEPCO has orally agreed to pay the City $215,160 for the easements. The <br />proceeds from these easements would be credited to the Public Utilities Fund. <br /> <br />Recommended Action: <br />. Adoption of the ordinance. Vision Principles: Bold New Directions and a Robust <br />and Prospering Economy. <br /> <br />Next Steps Following Council Action: <br />. All requisite legal documents will be executed and recorded. <br /> <br />1. Mark Geduldig-Yatrofsky, 2713 Sterling Point Drive, asked that any money recouped <br />from this project be refunded to citizens. <br /> <br />Motion by Mr. Heretick, and seconded by Ms. Psi mas, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE AUTHORIZING THE CONVEYANCE OF CERTAIN PROPERTY <br />INTERESTS NEEDED FOR CONSTRUCTION OF AN ELECTRIC TRANSMISSION <br />AND DISTRIBUTION LINE OVER AND ACROSS PROPERTY OF THE CITY OF <br />PORTSMOUTH IN THE CITY OF SUFFOLK, VIRGINIA." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />10 - 203 - Adoption of an ordinance to transfer $87,723 from the FY 2009-2010 General <br />Fund to the FY 2009-2010 Retirement Fund for the purpose of making a one-time <br />payment to 81 Portsmouth Supplemental Retirement System and Portsmouth Fire and <br />Police Pension recipients whose annual benefit falls below the U.S. Department of <br />Health and Human Services 2009 Poverty Guidelines. Vision Principle: A Robust and <br />Prospering Economy. <br />
