June 27, 1989 <br /> <br />Items Removed from the Consent Ag~enda were ~resented: <br /> <br /> The following items approved on first reading at the <br />Public Hearing of June 12, 1989 and the regular meeting of June <br />13, 1989'were taken up and read: <br /> <br />89-236 <br /> <br />Use Permit: <br /> <br /> (c) UP-89-5 Motion of Mr. Gray and seconded bp Mr. <br />Barnes, the following resolution approved on first reading was <br />adopted, and by the following vote: <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT TO JANUARY 16TH <br />ASSOCIATES FOR AN AUTOMOTIVE SERVICE STATION INCLUDING GASOLINE <br />PUMPS AND A CAR WASH IN CONJUNCTION WITH A CONVENIENCE STORE ON <br />THE WEST SID~ OF TOW~NE POINT-ROAD SOUT~ OF BICKFORD PARKWAY. <br /> <br /> ~HEREAS, January l~th Associates have made application <br />pursuant to [40-70 (b) of the Code of the City of Portsmouth, <br />Virginia, 1988, for the granting of a use permit as <br />hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said <br />application~ and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE I.T RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> i. That the use for which the use permit <br />hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing or working in the neighborhood of the <br />proposed use; <br /> <br />injurious <br />and <br /> <br /> (b) Will not be detrimental to the public use or <br />to the property or improvements of the neighborhood; <br /> <br /> (c) Will be in accordance with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. January 16th Associates is hereby granted a use permit <br />pursuant to ~40-~0 (b) of the Code of the City of Portsmouth, <br />Virginia, 1988, for an automotive service station including <br />gasoline pumps and car wash in conjunction with a convenience <br />store on the property on the west side of Towne Point ~Road lying <br />south of Bickford Par~kway, such property being more particularly <br />described as follows: <br /> <br /> UP-89-5 <br /> <br /> BEGINNING at the southeast intersection of Towne P~int <br />Road and Bickford Parkway (relocated); thence west along the <br />south right-of-way of Bickford Parkway 150', more or less; <br />thence southerly 150'!, thence east 150', <br />thence east 150' to the west right-of-way of Towne Point Road; <br />thence north 150' along said right-of-way to the Point of <br />Origin, such parcel being designated as Tax Map 833, Parcel 2.3. <br /> <br /> <br />
