554 August 22, 1989 Motion of Mrs. Lucas and seconded by Mr. Simpson, the following ordinance was adopted on first and final reading, and by the following vote: "AN'ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTION 32-29 THEREOF, PERTAINING TO BARBWIRE FENCES." Ayes: ~a~rnes, Corprew, Gray, Hawks, Lucas, Simpson, Webb Nays~ None 89-341 Letter from the City Manager recommending adoption of a resolu~ion authorizing the City Manager to release a utility easement on property of the Pqrtsmouth Port and Industfial.Co~mission. "~n 1.987, PortsmOuth Port and Industrial Commission granted a utility easement to the City of Portsmouth for future expansion of utility services in the area. The utility lines have not been inst~led in the easement as of this date. Subsequently, the Portsmouth Port and Industrial Commission acquired adjacent property ~rom Seaboard Coast Line Railroad to create a larger development parcel. The potential-developer has agreed to dedicate an easement on another area of the parcel which will not interfere with development. I recommend ~adoption of the resolution authorizing the release of the existing easement in order to accommodate the development of this property as promptly as possible." On motion motion of Mr. Simpson and seconded by Mr. Gray, the following resolution was adopted on first an~ final reading, and by the following vote: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE A UTILITY EASEMENT ON PROPERTY OF THE PORTSMOUTH PORT AND INDUSTRIAL COMMISSION. WHEREAS, by.agreement dated Julys8, 1987, recorded in the Clerk's Office.of the Circuit Court of the City of Portsmouth in Deed Book 991, Page 622, the Portsmouth Port and Industrial Commission conveyed a utility easemen~ and a temporary construction easement to the City of Portsmouth; and WHEREAS, the Portsmouth Port and. Industrial Commission subsequently acquired adjacent property from the Seaboard Coast Line Railroad; and WHEREAS, the Portsmouth Port and Industrial Commission has requested that the utility easement be~relocated in order to facilitate development of its property; and WHEREAS, the Council of the City of Portsmouth deems it to be in the best interest of the City to release the existing utility easement. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to release a utility easement on property of the Portsmouth Port and Industrial Commission as shown on that certain plat entitled "Plat Showing Existing Utility Easement.To Be Vacated By City Of Portsmouth", dated June 10, 1987, prepared by the Engineering and Technical Services Department of the City of Portsmouth.
