554 <br /> August 22, 1989 <br /> <br /> Motion of Mrs. Lucas and seconded by Mr. Simpson, the <br />following ordinance was adopted on first and final reading, and <br />by the following vote: <br /> <br /> "AN'ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1988, BY AMENDING SECTION 32-29 THEREOF, PERTAINING TO <br />BARBWIRE FENCES." <br /> <br /> Ayes: ~a~rnes, Corprew, Gray, Hawks, Lucas, Simpson, Webb <br /> Nays~ None <br /> <br /> 89-341 Letter from the City Manager recommending adoption <br />of a resolu~ion authorizing the City Manager to release a <br />utility easement on property of the Pqrtsmouth Port and <br />Industfial.Co~mission. <br /> <br /> "~n 1.987, PortsmOuth Port and Industrial Commission <br />granted a utility easement to the City of Portsmouth for future <br />expansion of utility services in the area. The utility lines <br />have not been inst~led in the easement as of this date. <br /> <br /> Subsequently, the Portsmouth Port and Industrial <br />Commission acquired adjacent property ~rom Seaboard Coast Line <br />Railroad to create a larger development parcel. <br /> <br /> The potential-developer has agreed to dedicate an easement <br />on another area of the parcel which will not interfere with <br />development. <br /> <br /> I recommend ~adoption of the resolution authorizing the <br />release of the existing easement in order to accommodate the <br />development of this property as promptly as possible." <br /> <br /> On motion motion of Mr. Simpson and seconded by Mr. Gray, <br />the following resolution was adopted on first an~ final reading, <br />and by the following vote: <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE A <br />UTILITY EASEMENT ON PROPERTY OF THE PORTSMOUTH PORT AND <br />INDUSTRIAL COMMISSION. <br /> <br /> WHEREAS, by.agreement dated Julys8, 1987, recorded in the <br />Clerk's Office.of the Circuit Court of the City of Portsmouth in <br />Deed Book 991, Page 622, the Portsmouth Port and Industrial <br />Commission conveyed a utility easemen~ and a temporary <br />construction easement to the City of Portsmouth; and <br /> <br /> WHEREAS, the Portsmouth Port and. Industrial Commission <br />subsequently acquired adjacent property from the Seaboard Coast <br />Line Railroad; and <br /> <br /> WHEREAS, the Portsmouth Port and Industrial Commission has <br />requested that the utility easement be~relocated in order to <br />facilitate development of its property; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth deems it to <br />be in the best interest of the City to release the existing <br />utility easement. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and he hereby <br />is, authorized to release a utility easement on property of the <br />Portsmouth Port and Industrial Commission as shown on that <br />certain plat entitled "Plat Showing Existing Utility Easement.To <br />Be Vacated By City Of Portsmouth", dated June 10, 1987, prepared <br />by the Engineering and Technical Services Department of the City <br />of Portsmouth. <br /> <br /> <br />
