578 <br /> September 12, 1989 <br /> <br />89-370 Letter from the City Manager recommending adoption of <br />a resolution expressing the opposition of the Council.of the <br />City of Portsmouth to the further expansion or prolongation of <br />Craney Island as a disposal area. <br /> <br /> "Earlie~ this year I forwarded to you. Mr. John Tuttle's <br />report regarding the status of the Army Corps of Engineers' <br />Craney Island Study. I also forwarded key correspondence and <br />prior Council action concerning our ongoing dialogue with <br />Federal and State agencies. <br /> <br /> Mr. Tuttle has recently informed me that it is his opinion <br />that the Corps of Engineers' report has been delayed and it is <br />not anticipated to be submitted to the Virginia Port Authority <br />until February or March 1990. The Virginia Port Authority at <br />Ghat time must make a decision regarding Craney Island prior to <br />applying for the necessary Federal and State permits and having <br />the General Assembl~ approve a bill for~the conveyance of <br />State-owned river ~bottom. <br /> <br /> As requested by City Council, a meeting was recently held <br />with our representatives in the United States Congress and <br />Virginia General Assembly to discuss the Army Corps of <br />Engineers' pending report and our concerns and objections as it <br />~elates to the~f~r~her expansion or prolongation of Craney <br />Island as a disposal area. Because the Virginia Port Authority <br />will be the Agency responsible for securing the necessary <br />Federal and'State permits, it was proposed that City Council <br />adopt a resolution re-stating our position. Additionally, <br />Frederick S. Fisher, Assistant Attorney General for the <br />Commonwealth of Virginia has indicated that for the Landfill to <br />be expanded, ~he Virginia General Assembly would be required to <br />approve a bill to transfer underwater'land (specifically, <br />conveyance of fee simple title or perpetual easements in <br />subaqueous beds of waterways). Such action would expand upon <br />past General Assembly action in 1946 and 1948. The Port <br />Authority will be the agency responsible for submitting a <br />recommendation to the Governor and Virginia General Assembly. <br /> <br /> The City Attorney has drafted the attached <br />submittal to the Virginia Port Authority, and I <br />adoption." <br /> <br />resolution for <br />recommend its <br /> <br /> On motion of Mrs. Lucas and seconded by Mr. Gray, the <br />following resolution was adopted on first and final reading, <br />by the following vote: <br /> <br />and <br /> <br /> "A RESOLUTION EXPRESSING THE OPPOSITION OF THE COUNCIL OF <br />THE CITY OF PORTSMOUTH TO THE FURTHER EXPANSION OR PROLONGATION <br />OF CRANE¥ ISLAND AS A DISPOSAL AREA. <br /> <br /> WHEREAS, the 1988 Session of the Virginia General Assembly <br />adopted House Joint Resolution 163 memorializing the Congress of <br />the United States and the United States Army Corps of Engineers <br />to develop recommendations regarding alternatives to the <br />expansion of Craney Island as a disposal area and to expedite <br />the availability of this land for development purposes; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth has <br />steadfastly expressed its opposition to the expansion or <br />unnecessary prolongation of the Craney Island disposal area, and <br />by Resolution 1988-54 endorsed the Virginia General Assembly's <br />Joint Resolution 163; and <br /> <br /> W~EREAS, the Army Corps of Engineers has proposed the <br />westward expansion of Craney Island to accommodate additional <br />spoil dredge from the Norfolk Harbor and Hampton Roads Shipping <br />Channels; and <br /> <br /> <br />
