<br />February 9. 2010 <br /> <br />At a Regular Meeting of the City Council on Tuesday, February 9, 2010, there <br />were present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, Douglas L. Smith, <br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />Pastor Charles Kelly, opened the meeting with prayer, which was followed by the <br />Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Randall, to approve the minutes of a <br />Called Meeting of January 26, 2010, and of a Regular Meeting of January 26, 2010, and <br />was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />. Introduction of the new Public Health Director Dr. Jose Rodriguez. <br /> <br />- Public Hearing - <br /> <br />10 - 63 - Public hearing on rezoning application: <br /> <br />(a) Z-10-01 WEST GROVEIMAPLE SHADE - The Rebkee Company seeks to rezone <br />several parcels 3115, 3117, 3121 Turnpike, 521, 523 Lenora Avenue and <br />1800 Frederick Boulevard from Office Residential OR-75, Residential <br />Multifamily RM-60 and Commercial C-2 to Commercial C-2 Conditional. <br />The Comprehensive Plan's Generalized Future Land Use Map <br />recommends a Mixed Use Corridor. Vision Principle: A Robust and <br />Prospering Economy. <br /> <br />1. Randy Royal, 501 Independence Parkway, Chesapeake, spoke in support of this <br />item. <br /> <br />2. Paul Landers, 402 Cabot Street, spoke in support of this item. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Smith, to concur with the <br />recommendation of the Planning Commission that Z-1 0-01 be approved on first reading, <br />and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- Unfinished Business - <br /> <br />Consent Aqenda: <br /> <br />10 - 42 - Code amendment and rezoning: <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to adopt the following <br />ordinances approved on first reading at the January 26, 2010 meeting, and was <br />adopted by the following vote: <br /> <br />10-42 (a): <br /> <br />"ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA <br />BY REPEALING CHAPTER 40 THEREOF, AND ADOPTING A NEW CHAPTER 40.1, <br />PERTAINING TO ZONING." <br />
