<br />(b) Z-09-04 <br /> <br />January 26. 2010 <br /> <br />CITYWIDE - The City of Portsmouth seeks to rescind Chapter 40 <br />Zoning and replace it with a comprehensively updated Zoning <br />Ordinance and adoption of a new city-wide Zoning Map (the <br />"Revised Map"). The Revised Map, in conjunction with revisions to <br />the zoning ordinance, as noticed above, are intended to implement <br />the visions and goals of the Destination 2025 Comprehensive Plan <br />through a major update to the existing City of Portsmouth Zoning <br />Ordinance and Zoning Map of 1991, as amended (the "Existing <br />Ordinance" and the "Existing Map"). When considered as a whole, <br />the current zoning ordinance is more than 20 years old and does <br />not reflect the vision expressed by the City's adopted <br />Comprehensive Plan. The districts have been updated and <br />modernized and the newly proposed ordinance, reflecting public <br />input received collectively over this past year, is designed to: make <br />the development regulations easier to use; strengthen emphasis on <br />building form; encourage compatible redevelopment; protect <br />existing neighborhood character; ease the nonconforming situation; <br />will add development review process improvements to facilitate <br />desired development patterns; and will ensure consistency between <br />the city's development regulations and the Comprehensive Plan. <br />Vision Principle: Bold New Directions. <br /> <br />There were no speakers. <br /> <br />Motion by Mr. Heretick, and seconded by Mr. Whitehurst, to concur with the <br />recommendation of the Planning Commission that Z-09-04 be approved on first reading, <br />and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />Consent Aqenda: <br /> <br />- Unfinished Business - <br /> <br />10 - 15 - Use permit, comprehensive plan and code amendment: <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Randall, to adopt the following <br />resolutions and ordinances approved on first reading at the January 12, 2010 meeting, <br />and was adopted by the following vote: <br /> <br />10-15 (a): <br /> <br />"RESOLUTION GRANTING A USE PERMIT (UP-09-16) TO CATHERINE STAFF TO <br />OPERATE A RESTAURANT AT 4640/4644 GEORGE WASHINGTON HIGHWAY. <br /> <br />WHEREAS, Catherine Staff has made application pursuant to Section 40-43.1 <br />of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit for <br />the operation of a restaurant at 4640/4644 George Washington Highway, Portsmouth, <br />Virginia; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br />
