<br />Januarv 26. 2010 <br /> <br />At a Regular Meeting of the City Council on Tuesday, January 26, 2010, there <br />were present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, Douglas L. Smith, <br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />Reverend Dr. John Throop, opened the meeting with prayer, which was followed <br />by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br />Motion by Mr. Heretick, and seconded by Mr. Smith, to approve the minutes of a <br />Called Meeting of January 12, 2010, of a Regular Meeting of January 12, 2010, and of a <br />Called Meeting of January 19,2009, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />10 - 41 - Presentations: <br /> <br />. Appreciation proclamation presented to Regional Fire Partners. <br /> <br />. Presentation of special lapel pins to newly appointed board and commission <br />members. <br /> <br />- Public Hearing - <br /> <br />10 - 42 - Public hearing on code amendment and rezoning applications: <br /> <br />(a) CA-09-07 <br /> <br />CITYWIDE - The City of Portsmouth seeks to rescind Chapter 40 <br />Zoning and replace it with a comprehensively updated Zoning <br />Ordinance and adoption of a new city-wide Zoning Map (the <br />"Revised Ordinance"). When considered as a whole, the current <br />zoning ordinance is more than 20 years old and does not reflect the <br />vision expressed by the City's adopted Comprehensive Plan. The <br />districts have been updated and modernized and the newly <br />proposed ordinance, reflecting public input received collectively <br />over this past year, is designed to: make the development <br />regulations easier to use; strengthen emphasis on building form; <br />encourage compatible redevelopment; protect existing <br />neighborhood character; ease the nonconforming situation; will add <br />development review process improvements to facilitate desired <br />development patterns; and will ensure consistency between the <br />city's development regulations and the Comprehensive Plan. <br />Vision Principle: Bold New Directions. <br /> <br />1. Cecilia Kelly, 720 Broad Street, voiced her concern with the issue of non-conforming <br />property and containers being used as buildings in the City. <br /> <br />2. Steve Carroll, 3112 Riveredge Drive, reminded City Council that it was their <br />responsibility to enforce the new zoning ordinance. <br /> <br />Motion by Ms. Randall, and seconded by Ms. Psimas, to concur with the <br />recommendation of the Planning Commission that CA-09-07 be approved on first <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br />
